Creates the Topical Eye Medication Act. Provides that every insurer that amends, delivers, issues, or renews an individual or group policy of accident and health insurance in this State that provides coverage for prescription topical eye medication shall not deny coverage for the refilling of a prescription for topical eye medication when certain conditions are met.

1 | | AN ACT concerning eye care coverage.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the |
5 | | Topical Eye Medication Prescription Act. |
6 | | Section 5. Coverage. Every insurer that amends, delivers, |
7 | | issues, or renews an individual or group policy of accident and |
8 | | health insurance in this State that provides coverage for |
9 | | prescription topical eye medication shall not deny coverage for |
10 | | the refilling of a prescription for topical eye medication |
11 | | when: |
12 | | (1) the medication is to treat a chronic condition of |
13 | | the eye; |
14 | | (2) the refill is requested by the insured prior to the |
15 | | last day of the prescribed dosage period and after at least |
16 | | 75% of the predicted days of use; and |
17 | | (3) the prescribing physician licensed to practice |
18 | | medicine in all its branches or optometrist indicates on |
19 | | the original prescription that refills are permitted and |
20 | | that the early refills requested by the insured do not |
21 | | exceed the total number of refills prescribed.
