2 | | AMENDMENT NO. ______. Amend House Bill 2641 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Counties Code is amended by changing |
5 | | Section 4-11001 and by adding Section 4-11003 as follows:

8 | | Sec. 4-11001. Juror fees. Each county
shall pay to grand |
9 | | and petit jurors for their services
in attending courts the sum |
10 | | of $4 for each day of necessary attendance at
such courts as |
11 | | jurors in counties of the first class, the sum of $5 for
each |
12 | | day in counties of the second class, and the sum of $10 for |
13 | | each
day in counties of the third class, or such higher amount |
14 | | as may be fixed by
the county board.

15 | | In addition, jurors shall receive such travel expense as
|
16 | | may be determined by the county board, provided that jurors in
|

1 | | counties of the first class and second class shall receive at

2 | | least 10 cents per mile for their travel expense.
Mileage shall |
3 | | be allowed for travel during a juror's term as well as for

5 | | If a judge so orders, a juror
shall also receive |
6 | | reimbursement for the actual cost of day care incurred by
the |
7 | | juror during his or her service on a jury.

8 | | The juror fees for service, transportation, and day care |
9 | | shall be paid out
of the county treasury.

10 | | The clerk of the court shall
furnish to each juror without |
11 | | fee whenever he is discharged a certificate
of the number of |
12 | | days' attendance at court, and upon presentation thereof
to the |
13 | | county treasurer, he shall pay to the juror the sum
provided |
14 | | for his service.

15 | | Any juror may elect to waive the fee paid for service, |
16 | | transportation, or day care, or any combination thereof. |

20 | | (a) This subsection (a) is operative from June 1, 2015 |
21 | | through November 30, 2015. Each county

25 | | first and second day and thereafter $32 for each day of |
26 | | necessary attendance, which may include an offset for travel, |

1 | | meal and other expenses otherwise incurred by jurors associated |
2 | | with jury service, except for day care, as determined by the |
3 | | county board. The county board may fix and approve a higher |
4 | | amount to compensate jurors for their services, travel, meal |
5 | | and other expenses.

6 | | If a judge so orders, a juror
shall also receive |
7 | | reimbursement for the actual cost of day care incurred by
the |
8 | | juror during his or her service on a jury.
|
9 | | The juror fees for service, transportation, meals, day |
10 | | care, and other expenses incurred by jurors associated with |
11 | | jury service shall be funded out
of the county treasury.
|
12 | | The clerk of the court shall
furnish to each juror without |
13 | | fee whenever he or she is discharged a certificate
of the |
14 | | number of days' attendance at court, and upon presentation |
15 | | thereof
to the county treasurer, he or she shall pay to the |
16 | | juror the sum
provided for his or her service.

21 | | Sec. 4-11003. Juror services fee. In addition to the jury |
22 | | demand fees provided in the Clerks of Courts Act, a county |
23 | | board may enact by ordinance or resolution a juror services fee |
24 | | not to exceed $15 that is dedicated to defraying expenses |
25 | | incurred by the county in paying jurors for their services if |

1 | | the fee is justified by an acceptable cost study showing that |
2 | | the fee is necessary to defray the costs of paying jurors for |
3 | | their services. Such fee shall be paid in every civil action |
4 | | not quasi-criminal in its nature and not a proceeding for the |
5 | | exercise of the right of eminent domain and in every other |
6 | | action wherein the right of trial by jury is or may be given by |
7 | | law. The fee shall be paid by the party demanding a jury at the |
8 | | time of filing the jury demand. |
9 | | All proceeds from this fee must be used to defray expenses |
10 | | incurred by the county in paying jurors for their services. The |
11 | | fees shall be collected in the manner in which all other court |
12 | | fees or costs are collected and shall be deposited into the |
13 | | county general fund for payment solely of costs incurred by the |
14 | | county in paying jurors for their services. |
15 | | Section 95. No acceleration or delay. Where this Act makes |
16 | | changes in a statute that is represented in this Act by text |
17 | | that is not yet or no longer in effect (for example, a Section |
18 | | represented by multiple versions), the use of that text does |
19 | | not accelerate or delay the taking effect of (i) the changes |
20 | | made by this Act or (ii) provisions derived from any other |
21 | | Public Act.

22 | | Section 99. Effective date. This Act takes effect on June |
23 | | 1, 2015, except the provisions adding Section 4-11003 to the |
24 | | Counties Code take effect on December 1, 2015.".
