| 2 | | AMENDMENT NO. ______. Amend House Bill 2487 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Illinois Seed Law is amended by changing |
| 5 | | Section 7 and adding Section 2.132a as follows:
|
| 6 | | (505 ILCS 110/2.132a new) |
| 7 | | Sec. 2.132a. Seed library. "Seed library" means a |
| 8 | | nonprofessional nonprofit, cooperative, or governmental |
| 9 | | organization that is registered on a website of a state-wide |
| 10 | | conservation organization and holds, donates, and receives |
| 11 | | donations of open-pollinated seeds to and from the public for |
| 12 | | non-commercial and educational uses for the purpose of |
| 13 | | encouraging horticulture-based education, non-commercial |
| 14 | | gardening, biodiversity, and the preservation of |
| 15 | | open-pollinated plant varieties.

| 2 | | Sec. 7. Exemptions. The provisions of Sections 4 through |
| 3 | | 4.5 and
Sections 5 and 5.1 do not
apply:
|
| 4 | | (1) To seed or grain not intended for sowing purposes.
|
| 5 | | (2) To seed in storage in, or being transported or |
| 6 | | consigned to a
cleaning or conditioning establishment for |
| 7 | | cleaning or
conditioning, provided,
that the invoice or |
| 8 | | labeling accompanying any shipment of said seed bears
the |
| 9 | | statement "seed for conditioning"; and provided that
any |
| 10 | | labeling or
other representation which may be made with respect |
| 11 | | to the uncleaned or
unconditioned seed shall be subject to this |
| 12 | | Act.
|
| 13 | | (3) To any carrier in respect to any seed transported or |
| 14 | | delivered for
transportation in the ordinary course of its |
| 15 | | business as a carrier;
provided, that such carrier is not |
| 16 | | engaged in producing, processing, or
marketing agricultural, |
| 17 | | vegetable or other seeds designated by the
Department of |
| 18 | | Agriculture subject to the provisions of this Act.
|
| 19 | | (4) To seed in an Illinois seed library that is as free |
| 20 | | from noxious and exotic weeds as possible. |

| 22 | | Section 99. Effective date. This Act takes effect upon |
| 23 | | becoming law.".
