10 | (a) To manage, operate, maintain, and preserve from waste

12 | real property transferred to the Department under Section | ||||||
13 | 405-415, including, without limitation, the State buildings
| ||||||
14 | listed below. The Department may rent portions of these

15 | other State buildings when in the judgment of the Director | ||||||

or subleases will be in the best interests of the |

interfere
with State

24 | usage of the facility. This authority is meant to supplement | ||||||
25 | and shall not
in any way be interpreted to restrict the | ||||||
26 | Director's ability to make
portions of the State of Illinois |

available for | ||||||
2 | long-term commercial leases or subleases.
| ||||||
3 | Notwithstanding the provisions above, the Department of | ||||||
4 | Children and
Family Services and the Department of Human | ||||||
5 | Services (as successor to
the Department of Rehabilitation | ||||||
6 | Services and the Department of Mental Health
and Developmental | ||||||
7 | Disabilities) shall determine
the allocation of space for | ||||||
8 | direct recipient care in their respective
facilities. The | ||||||
9 | Department of Central Management Services shall consult
with | ||||||
10 | the affected agency in the allocation and lease of surplus | ||||||
11 | space in
these facilities. Potential lease arrangements shall | ||||||
12 | not endanger the
direct recipient care responsibilities in | ||||||
13 | these facilities.
| ||||||
14 | (b) To appoint, subject to the Personnel Code, persons
to | ||||||
15 | be members of a police and security force. Members of the | ||||||
16 | security force
shall be peace officers when performing duties | ||||||
17 | pursuant to this Section
and as such shall have all of the | ||||||
18 | powers possessed by policemen in cities
and sheriffs, including | ||||||
19 | the power to make arrests on view or issue citations
for | ||||||
20 | violations of State statutes or city or county ordinances, | ||||||
21 | except
that in counties of more than 1,000,000 population, any | ||||||
22 | powers
created by this subsection shall be exercised only (i) | ||||||
23 | when necessary
to protect the property, personnel, or interests | ||||||
24 | of the Department or any State agency for whom the Department
| ||||||
25 | manages, operates, or maintains property or (ii) when | ||||||
26 | specifically
requested
by appropriate State or local
law |
| |||||||
| |||||||
1 | enforcement officials, and except that within counties of | ||||||
2 | 1,000,000
or less
population, these powers shall be exercised | ||||||
3 | only when necessary to
protect
the property, personnel, or | ||||||
4 | interests of the State of Illinois
and only
while on property | ||||||
5 | managed, operated, or maintained by the Department.
| ||||||
6 | Nothing in this subsection shall be construed so as to make | ||||||
7 | it conflict
with any provisions of, or rules promulgated under, | ||||||
8 | the Personnel
Code.
| ||||||
9 | (c) To charge reasonable fees for the lease, rental, use, | ||||||
10 | or occupancy of
State
facilities managed,
operated, or | ||||||
11 | maintained by the Department.
All
moneys
collected under this | ||||||
12 | Section
shall be deposited in a revolving
fund in the State | ||||||
13 | treasury known as the Facilities Management Revolving
Fund.
| ||||||
14 | (d) Provisions of this Section relating to the James R. | ||||||
15 | Thompson Center
are subject to the provisions of Section 7.4 of | ||||||
16 | the State Property Control
Act.
| ||||||
17 | (e) The use of electronic cigarettes, as that term is | ||||||
18 | defined under Section 10-20.5c of the School Code, is | ||||||
19 | prohibited in the hallways and common areas within any State | ||||||
20 | governmental building, except in Illinois Veterans' Homes | ||||||
21 | operated and maintained by the Illinois Department of Veterans' | ||||||
22 | Affairs. For the purposes of this subsection (e), "State | ||||||
23 | governmental building" means a structure owned by the State of | ||||||
24 | Illinois or any of its agencies or by any State university or | ||||||
25 | college or any of its corporate outgrowths thereof. | ||||||

| ||||||
2 | Section 10. The School Code is amended by adding Section | ||||||
3 | 10-20.5c as follows: | ||||||
4 | (105 ILCS 5/10-20.5c new) | ||||||
5 | Sec. 10-20.5c. Prohibition of the use of electronic | ||||||
6 | cigarettes. Each school board shall prohibit the use of | ||||||
7 | electronic cigarettes on school property, including, but not | ||||||
8 | limited to, in or on the grounds of any school, preschool, or | ||||||
9 | day care facility, or at any off-campus school-sponsored or | ||||||
10 | school-sanctioned event, by any school personnel, student, or | ||||||
11 | other person when such property is being used for any school | ||||||
12 | purposes. The school board may not authorize or permit any | ||||||
13 | exception to or exemption from the prohibition at any place or | ||||||
14 | at any time, including without limitation outside of school | ||||||
15 | buildings, before or after the regular school day, or on days | ||||||
16 | when school is not in session. "School purposes" include, but | ||||||
17 | are not limited to, all events or activities or other use of | ||||||
18 | school property that the school board or school officials | ||||||
19 | authorize or permit on school property, including without | ||||||
20 | limitation all interscholastic or extracurricular athletic, | ||||||
21 | academic, or other events sponsored by the school board or in | ||||||
22 | which pupils of the district participate. For purposes of this | ||||||
23 | Section, "electronic cigarette" means: (i) any device that | ||||||
24 | employs a battery or other mechanism to heat a solution or |

1 | substance to produce a vapor or aerosol intended for | ||||||
2 | inhalation; (ii) any cartridge or container of a solution or | ||||||
3 | substance intended to be used with or in such device or to | ||||||
4 | refill such a device; or (iii) any solution or substance, | ||||||
5 | whether or not it contains nicotine, intended for use in such | ||||||
6 | device. "Electronic cigarette" includes, but is not limited to, | ||||||
7 | any electronic nicotine delivery system, electronic cigar, | ||||||
8 | electronic cigarillo, electronic pipe, electronic hookah, vape | ||||||
9 | pen, or similar product or device, and any components or parts | ||||||
10 | that can be used to build such product or device. "Electronic | ||||||
11 | cigarette" does not include cigarettes, as that term is defined | ||||||
12 | under Section 1 of the Cigarette Tax Act, and tobacco products, | ||||||
13 | as that term is defined under Section 10-5 of the Tobacco | ||||||
14 | Products Tax Act of 1995. "Electronic cigarette" does not | ||||||
15 | include any asthma inhaler or any product that has been | ||||||
16 | approved by the United States Food and Drug Administration for | ||||||
17 | tobacco cessation, nicotine cessation, or other therapeutic | ||||||
18 | purpose if that product is marketed and sold solely for that | ||||||
19 | approved purpose. "Electronic cigarette" does not include any | ||||||
20 | device used by a registered qualifying patient under the | ||||||
21 | Compassionate Use of Medical Cannabis Pilot Program for the | ||||||
22 | ingestion of cannabis. | ||||||
23 | Section 15. The Board of Higher Education Act is amended by | ||||||
24 | adding Section 20 as follows: |

1 | (110 ILCS 205/20 new) | ||||||
2 | Sec. 20. Prohibition of use of electronic cigarettes. The | ||||||
3 | use of electronic cigarettes, as that term is defined in | ||||||
4 | Section 10-20.5c of the School Code, shall be prohibited in any | ||||||
5 | dormitory of any public or nonpublic institution of higher | ||||||
6 | education. For purposes of this Section, "nonpublic | ||||||
7 | institution of higher education" has the meaning given to that | ||||||
8 | term in Section 2 of the Higher Education Cooperation Act. ".
