1 | | AN ACT concerning regulation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Boxing and Full-contact Martial Arts Act is |
5 | | amended by changing Section 1 and by adding Section 6.5 as |
6 | | follows:
|

9 | | Sec. 1. Short title and definitions.
|
10 | | (a) This Act may be cited as the Boxing and Full-contact |
11 | | Martial Arts Act.
|
12 | | (b) As used in this Act:
|
13 | | "Department" means the Department of Financial and
|
14 | | Professional Regulation.
|
15 | | "Secretary" means the Secretary
of Financial and |
16 | | Professional Regulation.
|
17 | | "Board" means the State of Illinois Athletic Board
|
18 | | established pursuant to this Act.
|
19 | | "License" means the license issued for
promoters,
|
20 | | professionals, or officials
in accordance with this Act.
|
21 | | "Professional contest" means a
boxing or full-contact |
22 | | martial arts competition in which all of the participants |
23 | | competing against one another are professionals and where |

1 | | the public is able to attend or a fee is charged.
|
2 | | "Permit" means the authorization from the Department |
3 | | to a
promoter
to conduct professional or amateur contests, |
4 | | or a combination of both.
|
5 | | "Promoter" means a person who is licensed and
who
holds |
6 | | a permit to conduct professional or amateur contests, or a |
7 | | combination of both.
|
8 | | Unless the context indicates otherwise, "person" |
9 | | includes, but is not limited to, an individual,
|
10 | | association, organization, business entity, gymnasium, or |
11 | | club.
|
12 | | "Judge" means a person licensed by the Department who |
13 | | is
located at ringside or adjacent to the fighting area
|
14 | | during a professional contest
and who has the |
15 | | responsibility of scoring the performance of the
|
16 | | participants in that professional contest.
|
17 | | "Referee" means a person licensed by the Department who
|
18 | | has the
general
supervision of
and is present inside of the |
19 | | ring or fighting area during a professional contest.
|
20 | | "Amateur" means a person registered by the Department |
21 | | who is not competing for, and has never received or
|
22 | | competed for, any
purse or other
article of value, directly |
23 | | or indirectly, either for participating in any contest or |
24 | | for the
expenses of training therefor,
other than a |
25 | | non-monetary prize that does not exceed $50 in value.

26 | | "Professional" means a person licensed by the
|

1 | | Department who
competes for a
money prize, purse, or other |
2 | | type of compensation in a professional contest held in
|
3 | | Illinois.
|
4 | | "Second" means a person licensed by the Department who |
5 | | is
present at any professional
contest to provide |
6 | | assistance or advice to a professional during the contest.
|
7 | | "Matchmaker" means a person licensed by the Department |
8 | | who
brings
together professionals to compete in
contests.
|
9 | | "Manager" means a person licensed by the Department who |
10 | | is
not a
promoter and
who, under contract, agreement, or |
11 | | other arrangement, undertakes
to, directly or
indirectly, |
12 | | control or administer the affairs of professionals.
|
13 | | "Timekeeper" means a person licensed by the Department |
14 | | who
is the
official timer of
the length of rounds and the |
15 | | intervals between the rounds.
|
16 | | "Purse" means the financial guarantee or any other
|
17 | | remuneration for
which contestants
are participating in a |
18 | | professional contest.
|
19 | | "Physician" means a person licensed to practice |
20 | | medicine
in all its
branches under the Medical Practice Act |
21 | | of 1987.
|
22 | | "Martial arts" means a discipline or combination of |
23 | | different disciplines that utilizes sparring techniques |
24 | | without the intent to injure, disable, or incapacitate |
25 | | one's opponent, such as, but not limited to, Karate, Kung |
26 | | Fu, Judo, Jujutsu, Tae Kwon Do, and Kyuki-Do. |

1 | | "Full-contact martial arts" means the use of a singular |
2 | | discipline or a combination of techniques from different |
3 | | disciplines of the martial arts, including, without |
4 | | limitation, full-force grappling, kicking, and striking |
5 | | with the intent to injure, disable, or incapacitate one's |
6 | | opponent.

7 | | "Amateur contest" means a boxing or full-contact |
8 | | martial arts competition in which all of the participants |
9 | | competing against one another are amateurs and where the |
10 | | public is able to attend or a fee is charged. |
11 | | "Contestant" means a person who competes in either a |
12 | | boxing or full-contact martial arts contest. |
13 | | "Address of record" means the designated address |
14 | | recorded by the Department in the applicant's or licensee's |
15 | | application file, license file, or registration file as |
16 | | maintained by the Department's licensure maintenance unit. |
17 | | It is the duty of the applicant or licensee to inform the |
18 | | Department of any change of address and those changes must |
19 | | be made either through the Department's website or by |
20 | | contacting the Department. |
21 | | "Bout" means one match between 2 contestants. |
22 | | "Sanctioning body" means an organization approved by |
23 | | the Department under the requirements and standards stated |
24 | | in this Act and the rules adopted under this Act to act as |
25 | | a governing body that sanctions professional or amateur |
26 | | contests. |

|
1 | | "Elimination tournament" means a combative sports |
2 | | contest in which the contestants compete in a series of |
3 | | matches until not more than one contestant remains in any |
4 | | weight category. |

8 | | Sec. 6.5. Elimination tournaments. |
9 | | (a) All elimination tournaments conducted in this State |
10 | | must be conducted in accordance with this Section. |
11 | | (b) Before the start of any elimination tournament, the |
12 | | Department shall check all promoters,
professionals, and |
13 | | officials
associated with the elimination tournament for |
14 | | licenses issued by the Department. Any individual without a |
15 | | current license registered or issued by the Commission shall |
16 | | not participate in the event. |
17 | | (c) The promoter of an elimination tournament must: |
18 | | (1) complete an application provided by the |
19 | | Department; |
20 | | (2) provide a surety bond, cash, certificate of |
21 | | deposit, or other form of security acceptable to the |
22 | | Department in the amount of $5,000; the Department may |
23 | | increase the security as circumstances warrant; |
24 | | (3) provide medical insurance in the amount of at least |
25 | | $10,000 for each participant; and |

1 | | (4) submit a $50 permit fee. |
2 | | In addition, the promoter of an elimination tournament |
3 | | must: |
4 | | (A) arrange for an ambulance to be on site at each |
5 | | event with emergency medical personnel and proper |
6 | | resuscitation equipment; |
7 | | (B) provide 16-ounce boxing gloves that shall be worn |
8 | | by all participants; |
9 | | (C) provide headgear that shall be worn by all |
10 | | participants; |
11 | | (D) provide adequate security at each event; and |
12 | | (E) arrange spectator seating at least 6 feet away from |
13 | | the ring apron. |
14 | | The promoter of an elimination tournament may act as a |
15 | | matchmaker for the purposes of arranging bouts. |
16 | | Promoters of elimination tournaments may request the |
17 | | Department to not accept any participant due to conduct or |
18 | | safety. Upon approval of the request by the Department, the |
19 | | participant in question shall be banned from participating in |
20 | | the event. |
21 | | (d) Elimination tournaments shall consist of 3 one-minute |
22 | | rounds with a one-minute rest period between each round. Each |
23 | | round shall be judged on a 10-point must system. |
24 | | Elimination tournaments shall be single-elimination |
25 | | events. An elimination participant who has lost a bout may not |
26 | | participate in the same program of bouts. |

1 | | If a participant is knocked down 3 times in a round, that |
2 | | participant shall be declared the loser of the bout. |
3 | | If a bout is declared a draw, the judges shall reevaluate |
4 | | their scorecards and select a winner. |
5 | | The referee or the ringside physician may stop a bout if, |
6 | | in the judgment of either, allowing the bout to continue may |
7 | | jeopardize the health or the safety of a participant. |
8 | | Elimination tournaments may be one-night or 2-night |
9 | | events. Elimination tournament participants may not |
10 | | participate in more than one match during the first night of a |
11 | | 2-night elimination tournament. |
12 | | An elimination tournament participant may participate in |
13 | | any number of bouts the second night of a 2-night elimination |
14 | | tournament. |
15 | | Competing for or winning a prize in an elimination |
16 | | tournament shall not make the participant a professional within |
17 | | the scope of this Act unless all other participants in the |
18 | | tournament are professionals. |
19 | | Bouts between male and female participants shall not be |
20 | | permitted. |
21 | | (e) Participants in elimination tournaments shall: |
22 | | (1) be at least 18 years of age; |
23 | | (2) provide the Department with one form of photo |
24 | | identification with date of birth; |
25 | | (3) complete an application form provided by the |
26 | | Department; |

1 | | (4) submit the required license fee of $20; and |
2 | | (5) provide 2 photographs of himself or herself. |
3 | | An individual may not participate in elimination |
4 | | tournaments if he or she (i) has been a competitor in a |
5 | | professional boxing, kickboxing, or mixed martial arts |
6 | | competition or (ii) has been a winner of more than 5 of any |
7 | | combination of amateur boxing, kickboxing, or elimination |
8 | | tournament events in the past 5 years or more than 3 of any |
9 | | combination of amateur boxing, kickboxing, or elimination |
10 | | tournament events in the past 12 months, unless the event is |
11 | | restricted to winners of previous events. |
12 | | A participant shall not wear any type of body piercing, |
13 | | hard contact lenses, dentures, or removable dental work during |
14 | | a bout. A participant with dental braces may compete if the |
15 | | participant wears a fitted mouthpiece covering the entire |
16 | | brace. |
17 | | Male participants must wear a groin protector and a |
18 | | mouthpiece during all bouts. |
19 | | Female participants shall provide a negative pregnancy |
20 | | test that shall be verified by the ringside physician or they |
21 | | shall not be permitted to compete. |
22 | | (f) Each participant shall submit to and complete a |
23 | | pre-bout medical examination performed by a |
24 | | Department-appointed ringside physician before the elimination |
25 | | tournament begins. The physicals shall be performed at the |
26 | | location of the event, unless an alternate location is approved |

1 | | by the Department. The ringside physician shall be a physician |
2 | | licensed to practice medicine in all its branches or doctor of |
3 | | osteopathy. The examination shall cover the following, with the |
4 | | results written on a form provided by the Department: blood |
5 | | pressure, head, eyes, ears, nose, throat, lungs, chest, heart, |
6 | | and abdomen. |
7 | | No participant shall be allowed to participate in an |
8 | | elimination tournament if he or she is under the influence of |
9 | | alcohol or drugs. The Department may require elimination |
10 | | tournament participants to submit to an alcohol breathalyzer |
11 | | test at any time. |
12 | | If the ringside physician determines a participant is unfit |
13 | | to compete for any reason, that participant shall not |
14 | | participate in the elimination tournament. The ringside |
15 | | physician shall remain at ringside at all times during an |
16 | | elimination tournament bout and shall perform post-bout |
17 | | medical evaluations of all participants. The Department shall |
18 | | provide forms for the ringside physician to complete. |
19 | | (g) The promoter shall provide all of the following |
20 | | ringside at the elimination tournament: |
21 | | (1) a sufficient number of buckets for use by the |
22 | | participants; |
23 | | (2) stools for use by seconds; |
24 | | (3) rubber gloves for use by the referees, seconds, |
25 | | ringside physicians, and inspectors; |
26 | | (4) seats at ringside for the assigned officials, |

1 | | including a seat near the steps into the ring for the |
2 | | physician; |
3 | | (5) scales for weigh-ins, which the Department may |
4 | | require to be certified; |
5 | | (6) a bell; |
6 | | (7) a public address system; |
7 | | (8) a separate dressing room for both genders, if |
8 | | participants of each gender are participating; |
9 | | (9) a separate room for physical examinations; and |
10 | | (10) a separate dressing room for officials, unless the |
11 | | physical arrangements of the contest site make an |
12 | | additional dressing room impossible. |
13 | | (h) Elimination tournaments shall consist of the following |
14 | | 4 weight classes for male and female participants: |
15 | | (1) The lightweight class shall consist of |
16 | | participants of at least 140 but less than 160 pounds in |
17 | | weight. |
18 | | (2) The light heavyweight class shall consist of |
19 | | participants of at least 160 but less than 185 pounds in |
20 | | weight. |
21 | | (3) The heavyweight class shall consist of |
22 | | participants of at least 185 but less than 205 pounds in |
23 | | weight. |
24 | | (3) The super heavyweight class shall consist of |
25 | | participants of at least 205 pounds in weight. |
26 | | The promoter may add additional weight classes to the |
