70 ILCS 1235/1  from Ch. 105, par. 113

     Amends the Park Commissioners Land Sale Act. Provides that notice of an application for the sale of park district land not exceeding 3 acres shall be given at least ten days before the day of the hearing on the application. Provides that all interested persons may appear at the hearing of the application in Circuit Court.  Effective immediately.

1    AN ACT concerning local government.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Park Commissioners Land Sale Act is amended  
5by changing Section 1 as follows:
 



6    (70 ILCS 1235/1)  (from Ch. 105, par. 113)



7    Sec. 1. 
Any board of park commissioners having the
control 
8or supervision of any public park, boulevard, driveway or 
9highway,
and having any piece or parcel of land not exceeding 3 
10acres in area,
which shall no longer be needed or deemed 
11necessary or useful for the
purpose of said park, boulevard, 
12driveway or highway may apply to the
Circuit Court of the 
13county in which such piece or parcel of land is
situated, by 
14petition in writing for leave to sell the same. Notice of such

15application shall be given by said board of park commissioners 
16in some
newspaper published in said county at least ten days 
17before the day of the hearing on such application named

18therein, when said application will be made. All persons 
19interested may
appear before said Circuit Court either in 
20person or by attorney at the hearing on such when said

21application shall be made, and object to the granting thereof. 
22After
hearing all persons interested, if said court shall deem 
23the granting of
said application to be for the public interest,

1it shall direct that the
property mentioned in said 
2application, or any part thereof, be sold and
conveyed by the 
3said board of park commissioners for the use of said park,

4boulevard, driveway or highway, upon such terms and conditions 
5as the said
court may think proper.

7    Section 99. Effective date. This Act takes effect upon 
8becoming law.
