Amends the Illinois Municipal Code. Provides that no bicycle sharing system may operate a docking station in an area with posted signs that expressly prohibit parking at any time or during certain hours that is adjacent to any elementary or secondary school in any municipality. Defines "bicycle sharing system" and "docking station". Preempts home rule powers.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 11-80-24 as follows: |

7 | | Sec. 11-80-24. Bicycle sharing systems. No bicycle sharing |
8 | | system may operate a docking station in an area with posted |
9 | | signs that expressly prohibit parking at any time or during |
10 | | certain hours that is adjacent to any elementary or secondary |
11 | | school in any municipality. |
12 | | For purposes of this Section: |
13 | | "Bicycle sharing system" means a fleet of bicycles that are |
14 | | locked into a network of docking stations that may be rented |
15 | | from and returned to any station in the system. |
16 | | "Docking station" includes, but is not limited to, a |
17 | | touch-screen kiosk, station map, and a docking system that |
18 | | releases bicycles using a member key or code. |
19 | | A home rule municipality may not regulate bicycle sharing |
20 | | systems. This Section is a denial and limitation of home rule |
21 | | powers and functions under subsection (h) of Section 6 of |
22 | | Article VII of the Illinois Constitution.
