Amends the Criminal Code of 2012. In the statute concerning grooming, defines "child" as a person under 18 years of age. Provides that the penalty for grooming is a Class 3 (rather than a Class 4) felony if the child is 14 years of age or older or if the person believed by the offender to be a child purports to be 14 years of age or older. Provides that grooming is a Class 2 felony if the child is under 14 years of age or if the person believed by the offender to be a child purports to be under 14 years of age.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Criminal Code of 2012 is amended by changing |
5 | | Section 11-25 as follows: |
6 | | (720 ILCS 5/11-25) |
7 | | Sec. 11-25. Grooming. |
8 | | (a) A person commits the offense of grooming when he or she |
9 | | knowingly uses a computer on-line service, Internet service, |
10 | | local bulletin board service, or any other device capable of |
11 | | electronic data storage or transmission to seduce, solicit, |
12 | | lure, or entice, or attempt to seduce, solicit, lure, or |
13 | | entice, a child, a child's guardian, or another person believed |
14 | | by the person to be a child or a child's guardian, to commit |
15 | | any sex offense as defined in Section 2 of the Sex Offender |
16 | | Registration Act or to otherwise engage in any unlawful sexual |
17 | | conduct with a child or with another person believed by the |
18 | | person to be a child. |
19 | | (b) Sentence. Grooming is a Class 3 4 felony if the child |
20 | | is 14 years of age or older or if the person believed by the |
21 | | offender to be a child purports to be 14 years of age or older. |
22 | | Grooming is a Class 2 felony if the child is under 14 years of |
23 | | age or if the person believed by the offender to be a child |
