1    AN ACT concerning fish.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 



 
 
4    Section 5. The Fish and Aquatic Life Code is amended  by 
5changing Section 10-45 and  by adding Section 10-47 as follows:
 



6    (515 ILCS 5/10-45)  (from Ch. 56, par. 10-45)



7    Sec. 10-45. Taking of bait fishes shad. All casting nets 
8shall not be (1) larger
than 24 8 feet in diameter or (2) of a 
9mesh larger than 1 3/8 inch bar
measurement. All shad scoops 
10shall not be (1) larger than 30 inches in
diameter, (2) of a 
11mesh not larger than 1/2 inch bar measurement, or (3)
longer 
12than 4 feet in length. All
individuals using either of these 
13devices shall possess a valid sport
fishing license.

16    Sec. 10-47. Taking of fish by casting net or shad scoop for 
17use as bait. The following fish species may be taken with a 
18casting net or shad scoop and used for bait on the body of 
19water where they are collected if they are killed immediately:  
20bighead carp (Hypophthalmichthys nobilis), black carp 
21(Mylopharyngodon piceus), grass carp (Ctenopharyngodon 
22idella), and silver carp (Hypophthalmichthys molotrix).  The

1following fish species may be taken with a casting net or shad 
2scoop and used for live or dead bait on  the body of water where 
3they are collected: mooneye (Hiodon tergisus), goldeye (Hiodon 
4alosoides), skipjack herring (Alosa chrysochloris), carp 
5(other than bighead carp (Hypophthalmichthys nobilis), black 
6carp (Mylopharyngodon piceus), grass carp (Ctenopharyngodon 
7idella), and silver carp (Hypophthalmichthys molotrix)), and 
8any other fish listed in Section 10-110 of this Code. Any 
9person using casting nets or a shad scoop for the taking of 
10fish under this Section must possess a valid sport fishing 
11license.
