licensed under the Medical Practice Act |

4 | | Special activities in physical education shall be provided |
5 | | for pupils
whose physical or emotional condition, as determined |
6 | | by a person licensed
under the Medical Practice Act of 1987, |
7 | | prevents their participation in the
courses provided for normal |
8 | | children.
|
9 | | (b) A school board is authorized to excuse pupils enrolled
|
10 | | in grades 11 and 12 from engaging in physical education courses |
11 | | if those
pupils request to be excused for any of the following |
12 | | reasons: (1) for
ongoing participation in an interscholastic
|
13 | | athletic program; (2) to enroll in academic classes which are |
14 | | required for
admission to an institution of higher learning, |
15 | | provided that failure to
take such classes will result in the |
16 | | pupil being denied admission to the
institution of his or her |
17 | | choice; or (3) to enroll in academic classes
which are required |
18 | | for graduation from high school, provided that failure to
take |
19 | | such classes will result in the pupil being unable to graduate. |
20 | | A school board may excuse pupils in grades 9 through 12 from |
21 | | engaging in physical education courses if those pupils request |
22 | | to be excused and are enrolled in 2 or more Advanced Placement |
23 | | (AP) courses. A school board may excuse pupils in grades 9 |
24 | | through 12 from engaging in physical education courses if those |
25 | | pupils request to be excused and are enrolled in a dual credit |
26 | | course with an institution of higher learning. A school board |

1 | | that excuses pupils from engaging in physical education courses |
2 | | on the basis of the pupil's enrollment in Advanced Placement |
3 | | (AP) or dual credit courses may not excuse pupils from more |
4 | | than 2 school years of physical education courses, and the |
5 | | student may have no other electives, except for those electives |
6 | | required for college admission or high school graduation, for |
7 | | the school years during which they are excused from engaging in |
8 | | physical education courses. A school
board may also excuse |
9 | | pupils in grades 9 through 12 enrolled in a marching band
|
10 | | program for credit from engaging in physical education courses |
11 | | if those pupils
request to be excused for ongoing participation |
12 | | in such marching band
program. In addition, a pupil
in any of |
13 | | grades 3 through 12 who is eligible for special education may |
14 | | be excused if the pupil's parent or guardian agrees that the |
15 | | pupil
must utilize the time set aside for physical education to |
16 | | receive special education support and services or, if there is |
17 | | no agreement, the individualized education program team for the |
18 | | pupil determines that the pupil must utilize the time set aside |
19 | | for physical education to receive special education support and |
20 | | services, which agreement or determination must be made a part |
21 | | of the individualized education program. However, a pupil |
22 | | requiring adapted physical education must receive that service |
23 | | in accordance with the individualized education program |
24 | | developed for the pupil. If requested, a school board is |
25 | | authorized to excuse a pupil from engaging in a physical |
26 | | education course if the pupil has an individualized educational |

1 | | program under Article 14 of this Code, is participating in an |
2 | | adaptive athletic program outside of the school setting, and |
3 | | documents such participation as determined by the school board. |
4 | | A school board may also excuse pupils in grades 9 through 12 |
5 | | enrolled
in a Reserve Officer's Training Corps (ROTC) program |
6 | | sponsored by the school
district from engaging in physical |
7 | | education courses.
School boards which choose to exercise this |
8 | | authority shall establish a policy
to excuse pupils on an |
9 | | individual basis.

10 | | (c) The provisions of this Section are subject to the |
11 | | provisions of
Section 27-22.05.
