Amends the Counties Code. Provides that all counties with a population of less than 1,000,000 may incur an indebtedness for the construction, expansion, or remodeling of a county jail
and sheriff's residence, subject to a backdoor referendum (now, counties with a population of less than 80,000 may incur indebtedness for the construction of a county jail and sheriff's residence only by a direct referendum). Provides that counties with
a population of 500,000 or more inhabitants, but less than 1,000,000
inhabitants, may incur an indebtedness for
the construction, expansion, or remodeling of a county jail (instead of just construction or remodeling of a county jail). Provides that all counties may incur indebtedness for the
reconstruction and remodeling of an existing courthouse or the construction
of a new courthouse, subject to a backdoor referendum (now, counties with a population of less than 300,000 may incur that indebtedness only by a direct referendum). Makes a technical correction. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Counties Code is amended by changing |
5 | | Sections 6-3001, 6-3005, 6-4001, and 6-4003 as follows:
|
6 | | (55 ILCS 5/6-3001) (from Ch. 34, par. 6-3001)

7 | | Sec. 6-3001.
Counties of 80,000 but less than 500,000; |
8 | | Bonds for jail
and sheriff's residence. Any county having a |
9 | | population of 80,000 or more
inhabitants, but less than 500,000 |
10 | | inhabitants may by resolution of its
county board incur an |
11 | | indebtedness for the construction , expansion, or remodeling of |
12 | | a county jail
and sheriff's residence, and may issue and sell |
13 | | its bonds and levy taxes
upon all the taxable property of such |
14 | | county sufficient to pay the
principal thereof at maturity and |
15 | | to pay interest thereon as it falls due
but the total amount of |
16 | | such bonds, together with existing indebtedness,
shall not |
17 | | exceed the limitation provided by law for indebtedness of such
|
18 | | county. Taxes levied for the payment of the interest on and |
19 | | principal of
such bonds shall be in addition to the maximum of |
20 | | taxes provided by statute
for counties and shall not be subject |
21 | | to the limitation for county taxes
provided in Section 5-1024 |
22 | | 5-1020. In addition, a county having a population of
240,000 or |
23 | | more inhabitants bordering on the Mississippi River may by
