Amends the Board of Higher Education Act. Subject to appropriation, provides that the Board of Higher Education shall provide a total of $5 million, or such greater amount as may be appropriated in a given fiscal year, in public university tuition restraint incentives to public universities in this State that qualify. Provides that payments from the amount appropriated for public university tuition restraint incentives shall only be made to those public universities that certify to the Board on or before August 1, 2014 that the university's board of trustees did not adopt an increase in tuition and fee rates for resident undergraduate students after August 1, 2013 for the 2013-2014 academic year and that the board of trustees will not adopt an increase in tuition and fee rates for resident undergraduate students for the 2014-2015 academic year that is greater than 4.0%. Sets forth provisions concerning the determination of each public university's allocation of tuition restraint incentive funding and reporting requirements. Effective July 1, 2013.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Board of Higher Education Act is amended by |
5 | | adding Section 9.34 as follows: |
6 | | (110 ILCS 205/9.34 new) |
7 | | Sec. 9.34. Public university tuition restraint incentives. |
8 | | (a) In this Section: |
9 | | "Fee" means any fee authorized by a public university's |
10 | | board of trustees that will be paid by more than one-half of |
11 | | all resident undergraduate students at least once during their |
12 | | enrollment at a public university and the fees charged by a |
13 | | public university for on-campus room and board. For purposes of |
14 | | this definition, for a public university that compels resident |
15 | | undergraduate students to be covered by health insurance as a |
16 | | condition to enroll at the university, "fee" includes the |
17 | | annual amount a student is charged for coverage by the |
18 | | university-affiliated group health insurance policy if he or |
19 | | she does not provide proof that he or she is otherwise covered |
20 | | by health insurance. This definition does not apply to limited |
21 | | subsets of resident undergraduate students to be covered by |
22 | | health insurance for specific reasons other than general |
23 | | enrollment at the university. |

1 | | "Tuition and fee rate" means the average of full-time rates |
2 | | for all undergraduate classes, based on an average of the rates |
3 | | authorized by a public university's board of trustees and |
4 | | actually charged to students, deducting any uniformly-rebated |
5 | | or refunded amounts, for the 2 semesters with the highest |
6 | | levels of full-time equated resident undergraduate enrollment |
7 | | during the academic year. |
8 | | (b) Subject to appropriation, the Board shall provide a |
9 | | total of $5 million, or such greater amount as may be |
10 | | appropriated in a given fiscal year, in public university |
11 | | tuition restraint incentives to public universities in this |
12 | | State that qualify under this Section. Payments from the amount |
13 | | appropriated for public university tuition restraint |
14 | | incentives shall only be made to those public universities that |
15 | | certify to the Board on or before August 1, 2014 that the |
16 | | university's board of trustees did not adopt an increase in |
17 | | tuition and fee rates for resident undergraduate students after |
18 | | August 1, 2013 for the 2013-2014 academic year and that the |
19 | | board of trustees will not adopt an increase in tuition and fee |
20 | | rates for resident undergraduate students for the 2014-2015 |
21 | | academic year that is greater than 4.0%. A university |
22 | | increasing a fee that applies to a specific subset of students |
23 | | or courses shall provide sufficient information to the Board to |
24 | | prove that the increase applied to that subset will not cause |
25 | | the increase in the average amount of total tuition and fees |
26 | | authorized by a university's board of trustees that is paid by |

1 | | resident undergraduate students in the 2014-2015 academic year |
2 | | to exceed the limit established in this subsection (b). |
3 | | (c) Each public university's allocation of tuition |
4 | | restraint incentive funding under this Section shall be |
5 | | determined as follows: |
6 | | (1) The Board shall calculate an adjustment for each |
7 | | university by subtracting each university's reported |
8 | | percentage change in tuition and fee rates for the |
9 | | 2014-2015 academic year from 4.1%. If the result of the |
10 | | calculation in this subdivision (1) is less than 0.1%, the |
11 | | university is not qualified to receive an allocation under |
12 | | this Section. All calculations under this subdivision (1) |
13 | | shall be rounded to the first decimal place. |
14 | | (2) For each qualified university, the Board shall |
15 | | divide the university's adjustment as calculated under |
16 | | subdivision (1) of this subsection (c) by the sum of all |
17 | | adjustments for qualifying universities under subdivision |
18 | | (1) of this subsection (c) and then multiply the resulting |
19 | | calculation for each university by the total amount |
20 | | available for tuition restraint incentives, rounded to the |
21 | | nearest $100. |
22 | | (d) The Board shall implement uniform reporting |
23 | | requirements to ensure that a public university receiving a |
24 | | tuition restraint incentive under this Section has satisfied |
25 | | the requirements of this Section. The Board shall have the sole |
26 | | authority to determine if a public university has met the |

1 | | requirements of this Section. Information reported by a public |
2 | | university to the Board under this subsection (d) shall also be |
3 | | reported to the General Assembly as provided in Section 3.1 of |
4 | | the General Assembly Organization Act. |
5 | | (e) In conjunction with the uniform reporting requirements |
6 | | established under subsection (d) of this Section, each public |
7 | | university shall also report the following information to the |
8 | | Board and the General Assembly on or before August 1, 2014: |
9 | | (1) Actual or estimated fiscal year 2013-2014 and |
10 | | budgeted fiscal year 2014-2015 total general fund tuition |
11 | | and fee revenue. |
12 | | (2) Actual or estimated fiscal year 2013-2014 and |
13 | | budgeted fiscal year 2014-2015 total general fund revenue. |
14 | | (3) Actual or estimated fiscal year 2013-2014 and |
15 | | budgeted fiscal year 2014-2015 general fund expenditures |
16 | | for student financial aid. |
17 | | (4) Actual or estimated fiscal year 2013-2014 and |
18 | | budgeted fiscal year 2014-2015 total general fund |
19 | | expenditures. |
20 | | (5) Actual or estimated fiscal year 2013-2014 and |
21 | | budgeted fiscal year 2014-2015 total fiscal year equated |
22 | | student enrollment. |
23 | | (f) The Board may adopt any rules necessary to carry out |
24 | | its responsibilities under this Section.

25 | | Section 99. Effective date. This Act takes effect July 1, |
26 | | 2013.
