Creates the Accountable Care Organization Clinical Laboratory Testing Advisory Board Act. Provides that every accountable care organization providing diagnosis and treatment for patients in this State must establish an advisory board to consider and recommend guidelines or protocols for clinical laboratory testing. Provides that the membership of a clinical laboratory testing advisory board must include at least one physician who
is legally affiliated with the accountable care organization and
is a medical director of a clinical laboratory that is providing services for the accountable care organization. Provides that an advisory board may make recommendations to the accountable care organization's governing board for the adoption of guidelines or protocols with respect to clinical laboratory testing. Provides that nothing in the Act requires an accountable care organization's governing board to adopt a clinical laboratory testing guideline or protocol recommended by the accountable care organization's advisory board. Effective January 1, 2014.

3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the |
5 | | Accountable Care Organization Clinical Laboratory Testing |
6 | | Advisory Board Act. |
7 | | Section 5. Definitions. In this Act: |
8 | | "Advisory board" means a clinical laboratory testing |
9 | | advisory board established under this Act. |
10 | | "Clinical laboratory testing" means any test or analysis |
11 | | performed in a clinical laboratory as defined in Section 2-103 |
12 | | of the Illinois Clinical Laboratory and Blood Bank Act or that |
13 | | is otherwise subject to Section 353 of the Public Health |
14 | | Service Act (42 U.S.C. 263a). |
15 | | Section 10. Advisory board required. Every accountable |
16 | | care organization providing diagnosis and treatment for |
17 | | patients in this State must establish an advisory board to |
18 | | consider and recommend guidelines or protocols for clinical |
19 | | laboratory testing. |
20 | | Section 15. Advisory board membership. Every advisory |
21 | | board established under this Act must include in its membership |
