1 | AMENDMENT TO HOUSE BILL 1711

2 | AMENDMENT NO. ______. Amend House Bill 1711 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Illinois Municipal Code is amended by | ||||||
5 | changing Section 3.1-15-25 as follows:
| ||||||
6 | (65 ILCS 5/3.1-15-25) (from Ch. 24, par. 3.1-15-25)
| ||||||
7 | Sec. 3.1-15-25. Conservators of the peace; service of | ||||||
8 | warrants.
| ||||||
9 | (a) After receiving a certificate attesting to the | ||||||
10 | successful completion
of
a training course administered by the | ||||||
11 | Illinois Law Enforcement Training
Standards Board, the mayor, | ||||||
12 | aldermen,
president, trustees, marshal, deputy
marshals, and | ||||||
13 | policemen in municipalities with a population of less than | ||||||
14 | 1,000,000 shall be conservators
of the peace. After receiving a | ||||||
15 | certificate attesting to the successful completion of a | ||||||
16 | training course administered by the Illinois Law Enforcement |

1 | Training Standards Board, policemen in municipalities with a | ||||||
2 | population of 1,000,000 or more shall be conservators of the | ||||||
3 | peace. Conservators of the peace Those persons and others | ||||||
4 | authorized by
ordinance shall have power (i) to arrest or cause | ||||||
5 | to be arrested, with or
without process, all persons who break | ||||||
6 | the peace or are found violating
any municipal ordinance or any | ||||||
7 | criminal law of the State, (ii) to commit
arrested persons for | ||||||
8 | examination, (iii) if necessary, to detain arrested
persons in | ||||||
9 | custody over night or Sunday in any safe place or until they
| ||||||
10 | can be brought before the proper court, and (iv) to exercise | ||||||
11 | all other
powers as conservators of the peace prescribed by the | ||||||
12 | corporate authorities.

13 | (b) All warrants for the violation of municipal ordinances | ||||||
14 | or the State
criminal law, directed to any person, may be | ||||||
15 | served and executed within the
limits of a municipality by any | ||||||
16 | policeman or marshal of the
municipality. For that purpose, | ||||||
17 | policemen and marshals have all the
common law and statutory | ||||||
18 | powers of sheriffs.
