| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Eminent Domain Act is amended by changing |
| 5 | | Section 1-1-5 as follows:
|
| 6 | | (735 ILCS 30/1-1-5)
|
| 7 | | Sec. 1-1-5. Definitions. As used in this Act, except with |
| 8 | | with respect to the acquisition or damaging of property |
| 9 | | authorized under the O'Hare Modernization Act: |
| 10 | | "Acquisition of property", unless the context otherwise |
| 11 | | requires, includes the acquisition, damaging, or use of |
| 12 | | property or any right to or interest in property. |
| 13 | | "Blighted area", "blight", and "blighted" have the same |
| 14 | | meanings as under the applicable statute authorizing the |
| 15 | | condemning authority to exercise the power of eminent domain |
| 16 | | or, if those terms have no defined meaning under the applicable |
| 17 | | statute, then the same meanings as under Section 11-74.4-3 of |
| 18 | | the Illinois Municipal Code. |
| 19 | | "Condemning authority" means the State or any unit of local |
| 20 | | government, school district, or other entity authorized to |
| 21 | | exercise the power of eminent domain.
