SYNOPSIS AS INTRODUCED:
 

    Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the Offices of the Comptroller and Treasurer. Provides instead for a single Comptroller of the Treasury. Provides that the Comptroller of the Treasury shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. No Comptroller or Treasurer shall be elected in 2014 and thereafter. Effective otherwise upon conclusion of the terms of the Comptroller and the Treasurer elected in 2010.

3    RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Article V of the
9Illinois Constitution by changing Sections 1, 3, 7, and 18 and
10by repealing Section 17 as follows:

THE EXECUTIVE

13    (ILCON Art. V, Sec. 1)
14SECTION 1. OFFICERS
15    The Executive Branch shall include a Governor, Lieutenant
16Governor, Attorney General, Secretary of State, and
17Comptroller of the Treasury Comptroller and Treasurer elected
18by the electors of the State. They shall keep the public
19records and maintain a residence at the seat of government
20during their terms of office.

1SECTION 3. ELIGIBILITY
2    To be eligible to hold the office of Governor, Lieutenant
3Governor, Attorney General, Secretary of State, or Comptroller
4of the Treasury Comptroller or Treasurer, a person must be a
5United States citizen, at least 25 years old, and a resident of
6this State for the three years preceding his or her election.

9SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
10    If the Attorney General, Secretary of State, or Comptroller
11of the Treasury Comptroller or Treasurer fails to qualify or if
12the his office becomes vacant, the Governor shall fill the
13office by appointment. The appointee shall hold office until
14the elected officer qualifies or until a successor is elected
15and qualified as may be provided by law and shall not be
16subject to removal by the Governor. If the Lieutenant Governor
17fails to qualify or if the his office becomes vacant, it shall
18remain vacant until the end of the term.

21SECTION 17. COMPTROLLER - DUTIES (REPEALED)
22    The Comptroller, in accordance with law, shall maintain the
23State's central fiscal accounts, and order payments into and
24out of the funds held by the Treasurer.

3SECTION 18. COMPTROLLER OF THE TREASURY TREASURER - DUTIES
4    The Comptroller of the Treasury Treasurer, in accordance
5with law, shall (i) maintain the State's central fiscal

7him or her, (ii) be responsible for the safekeeping and
8investment of monies and securities deposited with him or her,
9and for their disbursement upon his or her order, and (iii)
10have the duties and powers that may be prescribed by law of the
11Comptroller.

SCHEDULE
14    A Comptroller of the Treasury, but not a Comptroller or
15Treasurer, shall be elected in 2014 and thereafter. This
16Constitutional Amendment otherwise takes effect upon the
17conclusion of the terms of the Comptroller and the Treasurer
18elected in 2010.
