Amends the Counties Code. Provides that the county board or board of county commissioners of a county may regulate by ordinance the use of road salt and de-icing chemicals and may require a permit for the use of road salt or de-icing chemicals. Provides that the regulations may apply to incorporated and unincorporated areas of the county.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Counties Code is amended by adding Section |
5 | | 5-1134 as follows: |
6 | | (55 ILCS 5/5-1134 new) |
7 | | Sec. 5-1134. Road salt and de-icing chemicals. The county |
8 | | board or board of county commissioners of a county may by |
9 | | ordinance regulate the use of road salt and de-icing chemicals, |
10 | | without limitation. The county board or board of county |
11 | | commissioners may regulate the storage of road salt and |
12 | | de-icing chemicals. The county board or board of county |
13 | | commissioners may require a permit for the use and storage of |
14 | | road salt or de-icing chemicals by public or private operators. |
15 | | Any regulations enacted pursuant to this Section apply to |
16 | | incorporated and unincorporated areas of the county. |
17 | | This Section applies to any road salt and de-icing |
18 | | chemicals that are not regulated pursuant to Section 14.4 of |
19 | | the Environmental Protection Act.
