SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-335

    Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. In a Section concerning the Illinois Transparency and Accountability Portal, provides that ITAP shall provide direct access to a database of current members of the General Assembly and State employees of the executive, legislative, and judicial branches. Provides that this database shall be sorted by Rutan status, status of position as subject to collective bargaining, and, for General Assembly members, per diem allowances and mileage paid.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-335 as follows:
 
7    (20 ILCS 405/405-335)
8    Sec. 405-335. Illinois Transparency and Accountability
9Portal (ITAP).
10    (a) The Department, within 12 months after the effective
11date of this amendatory Act of the 96th General Assembly, shall
12establish and maintain a website, known as the Illinois
13Transparency and Accountability Portal (ITAP), with a
14full-time webmaster tasked with compiling and updating the ITAP
15database with information received from all State agencies as
16defined in this Section.
17    (b) For purposes of this Section:
18    "State agency" means (i) the offices of the constitutional
19officers identified in Article V of the Illinois Constitution,
20executive agencies, and departments, boards, commissions, and
21Authorities under the Governor and (ii) for the purposes of
22paragraph (1) of subsection (c) only, State agencies under the
23jurisdiction of the Legislative Ethics Commission.

1    "Contracts" means payment obligations with vendors on file
2with the Office of the Comptroller to purchase goods and
3services exceeding $10,000 in value (or, in the case of
4professional or artistic services, exceeding $5,000 in value).
5    "Appropriation" means line-item detail of spending
6approved by the General Assembly and Governor, categorized by
7object of expenditure.
8    "Individual consultants" means temporary workers eligible
9to receive State benefits paid on a State payroll.
10    "Recipients" means State agencies receiving
11appropriations.
12    (c) The ITAP shall provide direct access to each of the
13following:
14        (1) A database of all current General Assembly members,
15    State employees of the executive, legislative, and
16    judicial branches, and individual consultants, except
17    sworn law enforcement officers, sorted separately by:
18            (i) Name.
19            (ii) Employing State agency, when applicable.
20            (iii) Employing State division, when applicable.
21            (iv) Position Employment position title.
22            (v) Current pay rate and year-to-date pay.
23            (vi) Year-to-date per diem allowance received for
24        food and lodging under Section 1 of the General
25        Assembly Compensation Act, for members of the General
26        Assembly.

1            (vii) Year-to-date mileage paid under Section 1 of
2        the General Assembly Compensation Act, for members of
3        the General Assembly.
4            (viii) Rutan status.
5            (ix) Status of position as subject to collective
6        bargaining.
7        (2) A database of all current State expenditures,
8    sorted separately by agency, category, recipient, and
9    Representative District.
10        (3) A database of all development assistance
11    reportable pursuant to the Corporate Accountability for
12    Tax Expenditures Act, sorted separately by tax credit
13    category, taxpayer, and Representative District.
14        (4) A database of all revocations and suspensions of
15    State occupation and use tax certificates of registration
16    and all revocations and suspensions of State professional
17    licenses, sorted separately by name, geographic location,
18    and certificate of registration number or license number,
19    as applicable. Professional license revocations and
20    suspensions shall be posted only if resulting from a
21    failure to pay taxes, license fees, or child support.
22        (5) A database of all current State contracts, sorted
23    separately by contractor name, awarding officer or agency,
24    contract value, and goods or services provided.
25        (6) A database of all employees hired after the
26    effective date of this amendatory Act of 2010, sorted

1    searchably by each of the following at the time of
2    employment:
3            (i) Name.
4            (ii) Employing State agency.
5            (iii) Employing State division.
6            (iv) Employment position title.
7            (v) Current pay rate and year-to-date pay.
8            (vi) County of employment location.
9            (vii) Rutan status.
10            (viii) Status of position as subject to collective
11        bargaining, subject to merit compensation, or exempt
12        under Section 4d of the Personnel Code.
13            (ix) Employment status as probationary, trainee,
14        intern, certified, or exempt from certification.
15            (x) Status as a military veteran.
16    (d) The ITAP shall include all information required to be
17published by subsection (c) of this Section that is available
18to the Department in a format the Department can compile and
19publish on the ITAP. The Department shall update the ITAP as
20additional information becomes available in a format that can
21be compiled and published on the ITAP by the Department.
22    (e) Each State agency shall cooperate with the Department
23in furnishing the information necessary for the implementation
24of this Section within a timeframe specified by the Department.
