| 1 | AMENDMENT TO SENATE BILL 1971

| 2 | AMENDMENT NO. ______. Amend Senate Bill 1971 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Mechanics Lien Act is amended by changing | ||||||
| 5 | Section 6 as follows:
| ||||||
| 6 | (770 ILCS 60/6) (from Ch. 82, par. 6)
| ||||||
| 7 | Sec. 6.
(a) This subsection (a) is operative on and for 5 | ||||||
| 8 | years after the effective date of this amendatory Act of the | ||||||
| 9 | 97th General Assembly and is inoperative on and after the day | ||||||
| 10 | after the date which is 5 years after the effective date of | ||||||
| 11 | this amendatory Act of the 97th General Assembly. In no event | ||||||
| 12 | shall it be necessary to fix or stipulate in any
contract a | ||||||
| 13 | time for the completion or a time for payment in order to | ||||||
| 14 | obtain
a lien under this act, provided, that the work is done | ||||||
| 15 | or material
furnished: within three years from the commencement | ||||||
| 16 | of said work or the
commencement of furnishing said material in | ||||||
| |||||||
| |||||||
| 1 | the case of work done or material
furnished as to | ||||||
| 2 | owner-occupied residential property; and within 5 years from | ||||||
| 3 | the commencement of said work or the
commencement of furnishing | ||||||
| 4 | said material in the case of work done or material
furnished as | ||||||
| 5 | to any other type of property.
| ||||||
| 6 | (b) This subsection (b) is inoperative on the effective | ||||||
| 7 | date of this amendatory Act of the 97th General Assembly and is | ||||||
| 8 | operative on and after the day after the date which is 5 years | ||||||
| 9 | after the effective date of this amendatory Act of the 97th | ||||||
| 10 | General Assembly. In no event shall it be necessary to fix or | ||||||
| 11 | stipulate in any
contract a time for the completion or a time | ||||||
| 12 | for payment in order to obtain
a lien under this Act, provided, | ||||||
| 13 | that the work is done or material
furnished within 3 years from | ||||||
| 14 | the commencement of the work or the
commencement of furnishing | ||||||
