SYNOPSIS AS INTRODUCED:

    Amends the Counties Code and the Illinois Municipal Code. Provides that beginning on January 1, 2012 and until January 1, 2017, the salaries of county board members and municipal officers may be diminished. Further provides that a county board member or a municipal officer may take up to 4 furlough days per calendar year, and the county or municipal treasurer, whichever is applicable, shall deduct the equivalent of 1/365th of the annual salary of each member or officer from the compensation of that member or officer once per quarter. Provides that the funds from the furlough days shall be transferred by the treasurer to the general fund of the county or municipality. Effective January 1, 2012.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Findings. The General Assembly makes the
5following findings:
6        (1) The first decade of the 21st Century has proven to
7    be one of nearly universal economic hardship.
8        (2) Illinois' counties and municipalities are not
9    immune to the resulting fiscal difficulties.
10        (3) In turn, Illinois' counties and municipalities are
11    asking their employees to do more with less.
12        (4) Officers of Illinois' counties and municipalities
13    are specifically protected under the law from receiving a
14    decrease in compensation.
15        (5) Therefore, it is the purpose of this legislation to
16    address this inequity while maintaining the valuable and
17    necessary services provided by Illinois' counties and
18    municipalities.
 
19    Section 5. The Counties Code is amended by changing Section
202-3008 and by adding Section 2-3020 as follows:

22    Sec. 2-3008. Determination of method of compensation of

1members of county board.
2    (a) This subsection applies until January 1, 2012 and on or
3after January 1, 2017. At the time it reapportions its county
4under this Division, the county board shall determine whether
5the salary to be paid the members to be elected shall be
6computed on a per diem basis, on an annual basis or on a
7combined per diem and annual basis, and shall fix the amount of
8that salary. If the county board desires before the next
9reapportionment to change the basis of payment or amount of
10compensation after fixing those items, it may do so by
11ordinance or by resolution. Those changes shall not however,
12take effect during the term for which an incumbent county board
13member has been elected. In addition, the county board shall
14determine the amount of any additional compensation for the
15chairman of the county board. The county board may adjust that
16additional compensation at any time adjustments in the salary
17of board members may be made. Those adjustments shall not
18however, take effect during the term for which the incumbent
19chairman of the county board has been elected.
20    (b) This subsection applies January 1, 2012 and until
21January 1, 2017. At the time it reapportions its county under
22this Division, the county board shall determine whether the
23salary to be paid the members to be elected shall be computed
24on a per diem basis, on an annual basis, or on a combined per
25diem and annual basis, and shall fix the amount of that salary.

5board may adjust that additional compensation at any time

9    Sec. 2-3020. Furlough days. During the calendar year
10beginning on January 1, 2012 and until January 1, 2017, every
11member of the county board may forfeit 4 days of compensation.
12If a county board member forfeits compensation, the county
13treasurer shall deduct the equivalent of 1/365th of the annual
14salary of each county board member from the compensation of
15that member once per quarter of the calendar year and transfer
16that amount to the general fund of the county.
 
17    Section 10. The Illinois Municipal Code is amended by
18changing Sections 3.1-50-5 and 3.1-50-10 and by adding Section
193.1-50-30 as follows:

21    Sec. 3.1-50-5. Establishment.
22    (a) This subsection applies until January 1, 2012 and on or
23after January 1, 2017. All municipal officers, except as

1otherwise provided, shall receive the salary or other
2compensation that is fixed by ordinance. Salaries or other
3compensation shall not be increased or diminished so as to take
4effect during the term of any officer holding an elective
5office. The salaries, fees, or other compensation of any
6appointed municipal officer, not including those appointed to
7fill vacancies in elective offices, may be increased but not
8diminished so as to take effect during the term for which the
9officer was appointed.
10    (b) This subsection applies January 1, 2012 and until
11January 1, 2017. All municipal officers, except as otherwise
12provided, shall receive the salary or other compensation that
13is fixed by ordinance. Salaries or other compensation shall not
14be increased so as to take effect during the term of any
15officer holding an elective office. The salaries, fees, or
16other compensation of any appointed municipal officer, not
17including those appointed to fill vacancies in elective
18offices, may be increased so as to take effect during the term
19for which the officer was appointed.

22    Sec. 3.1-50-10. Fixing salaries.
23    (a) This subsection applies until January 1, 2012 and on or
24after January 1, 2017. The corporate authorities of a
25municipality may fix the salaries of all municipal officers and

1employees in the annual appropriation or budget ordinance. They
2may fix the salary of all officers who hold elective office for
3a definite term in an ordinance other than the appropriation or
4budget ordinance. The salaries that are fixed in the annual
5appropriation ordinance shall neither be increased nor
6diminished during the fiscal year for which the appropriation
7is made. The salaries that are fixed by ordinance for those
8officers who hold elective office for a definite term shall
9neither be increased nor diminished during that term and shall
10be fixed at least 180 days before the beginning of the terms of
11the officers whose compensation is to be fixed.
12    (b) This subsection applies January 1, 2012 and until
13January 1, 2017. The corporate authorities of a municipality
14may fix the salaries of all municipal officers and employees in
15the annual appropriation or budget ordinance. They may fix the
16salary of all officers who hold elective office for a definite
17term in an ordinance other than the appropriation or budget
18ordinance. The salaries that are fixed in the annual
19appropriation ordinance shall not be increased during the
20fiscal year for which the appropriation is made. The salaries
21that are fixed by ordinance for those officers who hold
22elective office for a definite term shall not be increased
23during that term and shall be fixed at least 180 days before
24the beginning of the terms of the officers whose compensation
25is to be fixed.

2    Sec. 3.1-50-30. Furlough days. During the calendar year
3beginning on January 1, 2012 and until January 1, 2017, every
