AMENDMENT TO SENATE BILL 1859




2    AMENDMENT NO. ______. Amend Senate Bill 1859 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Good Samaritan Act is amended  by adding 
5Section 73 as follows:
 
6    (745 ILCS 49/73 new)
7    Sec. 73. School personnel; exemption from civil liability 
8for emergency care.  Any school personnel who in good faith 
9provide emergency medical or first aid care without fee to any 
10other school personnel or to any student enrolled in the school 
11district shall not, as a result of their acts or omissions, 
12except willful and wanton misconduct on the part of the school 
13personnel in providing the care, be liable to the person to 
14whom such care is provided for civil damages. For purposes of 
15this Section, "school personnel" means persons employed by, on 
16contract with, or serving as authorized volunteers in a school

1district.  This Section does not apply to any school personnel 
2who are licensed physicians, nurses, dentists, or other 
3licensed health services personnel. This Section does not 
4affect or in any way diminish or change an employer's liability 
5under the Workers' Compensation Act or the Workers' 
6Occupational Diseases Act.

 
7    Section 99. Effective date. This Act takes effect upon 
8becoming law.".
