SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12-6.2

    Amends the Criminal Code of 1961. Provides that in addition to other elements of the offense a person commits aggravated intimidation when he or she commits the offense of intimidation and the person knew that the victim was a civilian reporting information regarding a forcible felony to a law enforcement agency and the offense was committed because the person reported information regarding a forcible felony to a law enforcement agency.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 1961 is amended by changing
5Section 12-6.2 as follows:
 
6    (720 ILCS 5/12-6.2)
7    Sec. 12-6.2. Aggravated intimidation.
8    (a) A person commits the offense of aggravated intimidation
9when he or she commits the offense of intimidation and:
10        (1) the person committed the offense in furtherance of
11    the activities of an organized gang or by the person's
12    membership in or allegiance to an organized gang; or
13        (2) the offense is committed with the intent to prevent
14    any person from becoming a community policing volunteer; or
15        (3) the following conditions are met:
16            (A) the person knew that the victim was: (i) a
17        peace officer, (ii) a correctional institution
18        employee, (iii) a fireman; or (iv) a community policing
19        volunteer; or (v) a civilian reporting information
20        regarding a forcible felony to a law enforcement
21        agency; and
22            (B) the offense was committed: (i) while the victim
23        was engaged in the execution of his or her official

1        duties; or (ii) to prevent the victim from performing
2        his or her official duties; (iii) in retaliation for
3        the victim's performance of his or her official duties;
4        or (iv) by reason of any person's activity as a
5        community policing volunteer; or (v) because the
6        person reported information regarding a forcible
7        felony to a law enforcement agency.
8    (b) Sentence. Aggravated intimidation as defined in
9paragraph (a)(1) is a Class 1 felony. Aggravated intimidation
10as defined in paragraph (a)(2) or (a)(3) is a Class 2 felony
11for which the offender may be sentenced to a term of
12imprisonment of not less than 3 years nor more than 14 years.
13    (c) For the purposes of this Section, "streetgang",
14"streetgang member", and "organized gang" have the meanings
15ascribed to them in Section 10 of the Illinois Streetgang
16Terrorism Omnibus Prevention Act.
