1 | AN ACT concerning local government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Park District Aquarium and Museum Act is | ||||||
5 | amended by changing Section 1 as follows:
| ||||||
6 | (70 ILCS 1290/1) (from Ch. 105, par. 326)
| ||||||
7 | Sec. 1. Erect, operate, and maintain aquariums and museums. | ||||||
8 | The corporate authorities of cities and park districts having | ||||||
9 | the
control or supervision of any public park or parks, are | ||||||
10 | hereby authorized
to purchase, erect and maintain within any | ||||||
11 | public park or parks under the
control or supervision of such | ||||||
12 | corporate authorities, edifices to be used
as aquariums or as | ||||||
13 | museums of art, industry, science or natural or other
history, | ||||||
14 | or to permit the directors or trustees of any corporation or
| ||||||
15 | society organized for the construction or maintenance and | ||||||
16 | operation of an
aquarium or museum as hereinabove described to | ||||||
17 | erect, enlarge, ornament,
build, rebuild, rehabilitate, | ||||||
18 | improve, maintain and operate its aquarium or
museum or museums | ||||||
19 | within any public park now or hereafter under the control
or | ||||||
20 | supervision of any city or park district, and to contract with | ||||||
21 | any such
directors or trustees of any such aquarium, museum or | ||||||
22 | museums relative to
the erection, enlargement, ornamentation, | ||||||
23 | building, rebuilding,
rehabilitation, improvement, maintenance |

1 | and operation thereof. Any city or
park district may charge, or | ||||||
2 | permit such an aquarium or museum to charge,
an admission fee. | ||||||
3 | Any such aquarium or museum,
however, shall be open without | ||||||
4 | charge, when
accompanied by a teacher, to the children in | ||||||
5 | actual attendance upon grades
kindergarten through twelve in | ||||||
6 | any of the schools in this State at all
times. Any such | ||||||
7 | aquarium or museum, however, must be open to persons who reside | ||||||
8 | in this State the
public without
charge
for a period equivalent | ||||||
9 | to 52 days, at least 6 of which must be during the
period from | ||||||
10 | June through August, each year.
Notwithstanding said | ||||||
11 | provisions, charges may be made at any
time for
special | ||||||
12 | services and for admission to special facilities within any
| ||||||
13 | aquarium or museum for the education, entertainment or | ||||||
14 | convenience of
visitors. The proceeds of such admission fees | ||||||
15 | and charges for special
services and special facilities shall | ||||||
16 | be devoted exclusively to the
purposes for which the tax | ||||||
17 | authorized by Section 2 hereof may be used. If
any owner or | ||||||
18 | owners of any lands or lots abutting or fronting on any such
| ||||||
19 | public park, or adjacent thereto, have any private right, | ||||||
20 | easement,
interest or property in such public park appurtenant | ||||||
21 | to their lands or lots
or otherwise, which would be interfered | ||||||
22 | with by the erection and
maintenance of any aquarium or museum | ||||||
23 | as hereinbefore provided, or any
right to have such public park | ||||||
24 | remain open or vacant and free from
buildings, the corporate | ||||||
25 | authorities of the city or park district having
control of such | ||||||
26 | park, may condemn the same in the manner prescribed for the

of the right of eminent domain under the Eminent | ||||||
2 | Domain Act.
