Amends the State Finance Act. Creates the Grade Crossing Separation Fund as a special fund in the State treasury. Provides that $5,000,000 shall be transferred to the Fund from the Motor Fuel Tax Fund each month. Provides that moneys in the Fund shall be used by the Department of Transportation to separate railroad crossings used by passenger rail operators. Provides that the Department may adopt rules to administer the Fund. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The State Finance Act is amended by adding |
5 | | Sections 5.786 and 6z-87 as follows: |

7 | | Sec. 5.786. The Grade Crossing Separation Fund. |

10 | | The Grade Crossing Separation Fund is created as a special fund |
11 | | in the State treasury. On or before the last day of each month, |
12 | | the Comptroller shall order transferred and the Treasurer shall |
13 | | transfer $5,000,000 from the Motor Fuel Tax Fund to the Grade |
14 | | Crossing Separation Fund. Subject to appropriation, moneys in |
15 | | the Grade Crossing Separation Fund shall be used by the |
16 | | Department of Transportation exclusively for the purpose of |
17 | | separating railroad crossings used by passenger rail |
18 | | operators, with priority given to crossings with the highest |
19 | | amounts of road traffic. The Department of Transportation may |
20 | | adopt rules to implement this Section.
