1 | | AN ACT concerning finance.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Promotion Act is amended by |
5 | | changing Section 4a as follows:
|
6 | | (20 ILCS 665/4a) (from Ch. 127, par. 200-24a)
|
7 | | Sec. 4a. Funds.
|
8 | | (1) All moneys deposited in the Tourism Promotion Fund |
9 | | pursuant to this
subsection are allocated to the Department for |
10 | | utilization, as
appropriated, in the performance of its powers |
11 | | under Section 4.
|
12 | | As soon as possible after the first day of each month, |
13 | | beginning July 1,
1997, upon certification of the Department of |
14 | | Revenue, the Comptroller shall
order transferred and the |
15 | | Treasurer shall transfer from the General Revenue
Fund to the |
16 | | Tourism Promotion Fund an amount equal to 13% of the net
|
17 | | revenue realized from the Hotel Operators' Occupation Tax Act |
18 | | plus an amount
equal to 13% of the net revenue realized from |
19 | | any tax imposed under
Section
4.05 of the Chicago World's |
20 | | Fair-1992 Authority Act during the preceding month.
"Net |
21 | | revenue realized for a month" means the revenue collected by |
22 | | the State
under that Act during the previous month less the |
23 | | amount paid out during that
same month as refunds to taxpayers |

Act.

2 | | (1.1) (Blank).

3 | | (2) As soon as possible after the first day of each month,
|
4 | | beginning July 1,
1997, upon certification of the Department of |
5 | | Revenue, the Comptroller shall
order transferred and the |
6 | | Treasurer shall transfer from the General Revenue
Fund to the |
7 | | Tourism
Promotion Fund an amount equal to 8% of the net revenue |
8 | | realized from the Hotel
Operators' Occupation Tax plus an |
9 | | amount equal to 8% of the net revenue
realized from any tax |
10 | | imposed under Section 4.05 of the Chicago World's
Fair-1992 |
11 | | Authority Act during the preceding month. "Net revenue realized |
12 | | for
a
month" means the revenue collected by the State under |
13 | | that Act during the
previous month less the amount paid out |

taxpayers for overpayment |
15 | | of liability under that Act.

16 | | All monies deposited in the Tourism Promotion Fund under |
17 | | this
subsection (2) shall be used solely as provided in this |
18 | | subsection to
advertise and promote tourism throughout |
19 | | Illinois. Appropriations of monies
deposited in the Tourism |
20 | | Promotion Fund pursuant to this subsection (2)
shall be used |
21 | | solely for advertising to promote tourism, including but not
|
22 | | limited to advertising production and direct advertisement |
23 | | costs, but shall
not be used to employ any additional staff, |
24 | | finance any individual event,
or lease, rent or purchase any |
25 | | physical facilities. The Department shall
coordinate its |
26 | | advertising under this subsection (2) with other public and
|

|
1 | | private entities in the State engaged in similar promotion |
2 | | activities.
Print or electronic media production made pursuant |
3 | | to this subsection (2)
for advertising promotion shall not |
4 | | contain or include the physical
appearance of or reference to |
5 | | the name or position of any public officer.
"Public officer" |
6 | | means a person who is elected to office pursuant to
statute, or |
7 | | who is appointed to an office which is established, and the
|
8 | | qualifications and duties of which are prescribed, by statute, |
9 | | to discharge
a public duty for the State or any of its |
10 | | political subdivisions. |
11 | | (3) Notwithstanding anything in this Section to the |
12 | | contrary, amounts transferred from the General Revenue Fund to |
13 | | the Tourism Promotion Fund pursuant to this Section shall not |
14 | | exceed $26,300,000 in State fiscal year 2012.

16 | | Section 10. The State Finance Act is amended by changing |
17 | | Sections 6p-2, 6z-32, 6z-63, 6z-64, 6z-81, 8.49, 8g, and 8o and |
18 | | adding Section 8.51 as follows:

19 | | (30 ILCS 105/6p-2) (from Ch. 127, par. 142p2)
|
20 | | Sec. 6p-2.
The Communications Revolving Fund shall be |
21 | | initially financed
by a transfer of funds from the General |
22 | | Revenue Fund. Thereafter, all fees
and other monies received by |
23 | | the Department of Central Management Services in
payment for |
24 | | communications services rendered pursuant to the Department of
|

|
1 | | Central Management Services Law or sale of surplus State |
2 | | communications
equipment shall be paid into the Communications |
3 | | Revolving Fund. Except as
otherwise provided in this Section, |
4 | | the money in this fund shall be used by the
Department of |
5 | | Central Management Services as reimbursement for expenditures
|
6 | | incurred in relation to communications services.
|
7 | | On the effective date of this
amendatory Act of the 93rd |
8 | | General Assembly, or as soon as practicable
thereafter, the |
9 | | State Comptroller shall order transferred and the State
|
10 | | Treasurer shall transfer $3,000,000 from the Communications |
11 | | Revolving Fund to
the Emergency Public Health Fund to be used |
12 | | for the purposes specified in
Section 55.6a of the |
13 | | Environmental Protection Act.
|
14 | | In addition to any other transfers that may be provided for |
15 | | by law, on July 1, 2011, or as soon thereafter as practical, |
16 | | the State Comptroller shall direct and the State Treasurer |
17 | | shall transfer the sum of $5,000,000 from the General Revenue |
18 | | Fund to the Communications Revolving Fund. |

22 | | Sec. 6z-32. Partners for Planning and Conservation.
|
23 | | (a) The Partners for Conservation Fund (formerly known as |
24 | | the Conservation 2000 Fund) and the Partners for
Conservation |
25 | | Projects Fund (formerly known as the Conservation 2000 Projects |
|

1 | | Fund) are
created as special funds in the State Treasury. These |
2 | | funds
shall be used to establish a comprehensive program to |
3 | | protect Illinois' natural
resources through cooperative |
4 | | partnerships between State government and public
and private |
5 | | landowners. Moneys in these Funds may be
used, subject to |
6 | | appropriation, by the Department of Natural Resources, |
7 | | Environmental Protection Agency, and the
Department of |
8 | | Agriculture for purposes relating to natural resource |
9 | | protection,
planning, recreation, tourism, and compatible |
10 | | agricultural and economic development
activities. Without |
11 | | limiting these general purposes, moneys in these Funds may
be |
12 | | used, subject to appropriation, for the following specific |
13 | | purposes:
|
14 | | (1) To foster sustainable agriculture practices and |
15 | | control soil erosion
and sedimentation, including grants |
16 | | to Soil and Water Conservation Districts
for conservation |
17 | | practice cost-share grants and for personnel, educational, |
18 | | and
administrative expenses.
|
19 | | (2) To establish and protect a system of ecosystems in |
20 | | public and private
ownership through conservation |
21 | | easements, incentives to public and private
landowners, |
22 | | natural resource restoration and preservation, water |
23 | | quality protection and improvement, land use and watershed |
24 | | planning, technical assistance and grants, and
land |
25 | | acquisition provided these mechanisms are all voluntary on |
26 | | the part of the
landowner and do not involve the use of |

|
1 | | eminent domain.
|
2 | | (3) To develop a systematic and long-term program to |
3 | | effectively measure
and monitor natural resources and |
4 | | ecological conditions through investments in
technology |
5 | | and involvement of scientific experts.
|
6 | | (4) To initiate strategies to enhance, use, and |
7 | | maintain Illinois' inland
lakes through education, |
8 | | technical assistance, research, and financial
incentives.
|
9 | | (5) To partner with private landowners and with units |
10 | | of State, federal, and local government and with |
11 | | not-for-profit organizations in order to integrate State |
12 | | and federal programs with Illinois' natural resource |
13 | | protection and restoration efforts and to meet |
14 | | requirements to obtain federal and other funds for |
15 | | conservation or protection of natural resources.
|
16 | | (b) The State Comptroller and State Treasurer shall |
17 | | automatically transfer
on the last day of each month, beginning |
18 | | on September 30, 1995 and ending on
June 30, 2021,
from the |
19 | | General Revenue Fund to the Partners for Conservation
Fund,
an
|
20 | | amount equal to 1/10 of the amount set forth below in fiscal |
21 | | year 1996 and
an amount equal to 1/12 of the amount set forth |
22 | | below in each of the other
specified fiscal years:

10 | | (c) Notwithstanding any other provision of law to the |
11 | | contrary and in addition to any other transfers that may be |
12 | | provided for by law, on the last day of each month beginning on |
13 | | July 31, 2006 and ending on June 30, 2007, or as soon |
14 | | thereafter as may be practical, the State Comptroller shall |
15 | | direct and the State Treasurer shall transfer $1,000,000 from |
16 | | the Open Space Lands Acquisition and Development Fund to the |
17 | | Conservation 2000 Fund.

18 | | (d) There shall be deposited into the Partners for
|
19 | | Conservation Projects Fund such
bond proceeds and other moneys |
20 | | as may, from time to time, be provided by law.

24 | | Sec. 6z-63. The Professional Services Fund. |
25 | | (a) The Professional Services Fund is created as a |

1 | | revolving fund in the State treasury. The following moneys |
2 | | shall be deposited into the Fund: |
3 | | (1) amounts authorized for transfer to the Fund from |
4 | | the General Revenue Fund and other State funds (except for |
5 | | funds classified by the Comptroller as federal trust funds |
6 | | or State trust funds) pursuant to State law or Executive |
7 | | Order; |
8 | | (2) federal funds received by the Department of Central |
9 | | Management Services (the "Department") as a result of |
10 | | expenditures from the Fund; |
11 | | (3) interest earned on moneys in the Fund; and |
12 | | (4) receipts or inter-fund transfers resulting from |
13 | | billings issued by the Department to State agencies for the |
14 | | cost of professional services rendered by the Department |
15 | | that are not compensated through the specific fund |
16 | | transfers authorized by this Section. |
17 | | (b) Moneys in the Fund may be used by the Department for |
18 | | reimbursement or payment for: |
19 | | (1) providing professional services to State agencies |
20 | | or other State entities; |
21 | | (2) rendering other services to State agencies at the |
22 | | Governor's direction or to other State entities upon |
23 | | agreement between the Director of Central Management |
24 | | Services and the appropriate official or governing body of |
25 | | the other State entity; or |
26 | | (3) providing for payment of administrative and other |

|
1 | | expenses incurred by the Department in providing |
2 | | professional services. |
3 | | (c) State agencies or other State entities may direct the |
4 | | Comptroller to process inter-fund
transfers or make payment |
5 | | through the voucher and warrant process to the Professional |
6 | | Services Fund in satisfaction of billings issued under |
7 | | subsection (a) of this Section. |
8 | | (d) Reconciliation. For the fiscal year beginning on July |
9 | | 1, 2004 only, the Director of Central Management Services (the |
10 | | "Director") shall order that each State agency's payments and |
11 | | transfers made to the Fund be reconciled with actual Fund costs |
12 | | for professional services provided by the Department on no less |
13 | | than an annual basis. The Director may require reports from |
14 | | State agencies as deemed necessary to perform this |
15 | | reconciliation. |
16 | | (e) The following amounts are authorized for transfer into |
17 | | the
Professional Services Fund for the fiscal year beginning |
18 | | July 1, 2004: |

25 | | shall direct and the State Treasurer shall transfer amounts |

1 | | Sec. 6z-64. The Workers' Compensation Revolving Fund. |
2 | | (a) The Workers' Compensation Revolving Fund is created as |
3 | | a revolving fund, not subject to fiscal year limitations, in |
4 | | the State treasury. The following moneys shall be deposited |
5 | | into the Fund: |
6 | | (1) amounts authorized for transfer to the Fund from |
7 | | the General Revenue Fund and other State funds (except for |
8 | | funds classified by the Comptroller as federal trust funds |
9 | | or State trust funds) pursuant to State law or Executive |
10 | | Order; |
11 | | (2) federal funds received by the Department of Central |
12 | | Management Services (the "Department") as a result of |
13 | | expenditures from the Fund; |
14 | | (3) interest earned on moneys in the Fund; |
15 | | (4) receipts or inter-fund transfers resulting from |
16 | | billings issued by the Department to State agencies and |
17 | | universities for the cost of workers' compensation |
18 | | services rendered by the Department that are not |
19 | | compensated through the specific fund transfers authorized |
20 | | by this Section, if any; |
21 | | (5) amounts received from a State agency or university |
22 | | for workers' compensation payments for temporary total |
23 | | disability, as provided in Section 405-105 of the |
24 | | Department of Central Management Services Law of the Civil |
25 | | Administrative Code of Illinois; and |
26 | | (6) amounts recovered through subrogation in workers' |

1 | | compensation and workers' occupational disease cases. |
2 | | (b) Moneys in the Fund may be used by the Department for |
3 | | reimbursement or payment for: |
4 | | (1) providing workers' compensation services to State |
5 | | agencies and State universities; or |
6 | | (2) providing for payment of administrative and other |
7 | | expenses incurred by the Department in providing workers' |
8 | | compensation services. |
9 | | (c) State agencies may direct the Comptroller to process |
10 | | inter-fund
transfers or make payment through the voucher and |
11 | | warrant process to the Workers' Compensation Revolving Fund in |
12 | | satisfaction of billings issued under subsection (a) of this |
13 | | Section. |
14 | | (d) Reconciliation. For the fiscal year beginning on July |
15 | | 1, 2004 only, the Director of Central Management Services (the |
16 | | "Director") shall order that each State agency's payments and |
17 | | transfers made to the Fund be reconciled with actual Fund costs |
18 | | for workers' compensation services provided by the Department |
19 | | and attributable to the State agency and relevant fund on no |
20 | | less than an annual basis. The Director may require reports |
21 | | from State agencies as deemed necessary to perform this |
22 | | reconciliation. |
23 | | (d-5) Notwithstanding any other provision of State law to |
24 | | the contrary, on or after July 1, 2005 and until June 30, 2006, |
25 | | in addition to any other transfers that may be provided for by |
26 | | law, at the direction of and upon notification of the Director |

12 | | Sec. 6z-81. Healthcare Provider Relief Fund. |
13 | | (a) There is created in the State treasury a special fund |
14 | | to be known as the Healthcare Provider Relief Fund. |
15 | | (b) The Fund is created for the purpose of receiving and |
16 | | disbursing moneys in accordance with this Section. |
17 | | Disbursements from the Fund shall be made only as follows: |
18 | | (1) Subject to appropriation, for payment by the |
19 | | Department of Healthcare and
Family Services or by the |
20 | | Department of Human Services of medical bills and related |
21 | | expenses, including administrative expenses, for which the |
22 | | State is responsible under Titles XIX and XXI of the Social |
23 | | Security Act, the Illinois Public Aid Code, the Children's |
24 | | Health Insurance Program Act, the Covering ALL KIDS Health |
25 | | Insurance Act, and the Senior Citizens and Disabled Persons |

1 | | Property Tax Relief and Pharmaceutical Assistance Act. |
2 | | (2) For repayment of funds borrowed from other State

4 | | (c) The Fund shall consist of the following: |
5 | | (1) Moneys received by the State from short-term
|
6 | | borrowing pursuant to the Short Term Borrowing Act on or |
7 | | after the effective date of this amendatory Act of the 96th |
8 | | General Assembly. |
9 | | (2) All federal matching funds received by the
Illinois |
10 | | Department of Healthcare and Family Services as a result of |
11 | | expenditures made by the Department that are attributable |
12 | | to moneys deposited in the Fund. |
13 | | (3) All federal matching funds received by the
Illinois |
14 | | Department of Healthcare and Family Services as a result of |
15 | | federal approval of Title XIX State plan amendment |
16 | | transmittal number 07-09. |
17 | | (4) All other moneys received for the Fund from any
|
18 | | other source, including interest earned thereon. |
19 | | (d) In addition to any other transfers that may be provided |
20 | | for by law, on the effective date of this amendatory Act of the |
21 | | 97th General Assembly, or as soon thereafter as practical, the |
22 | | State Comptroller shall direct and the State Treasurer shall |
23 | | transfer the sum of $365,000,000 from the General Revenue Fund |
24 | | into the Healthcare Provider Relief Fund.

25 | | (e) In addition to any other transfers that may be provided |
26 | | for by law, on July 1, 2011, or as soon thereafter as |

26 | | (b) On and after the effective date of this amendatory Act |

1 | | of the 96th General Assembly through June 30, 2010, when any of |
2 | | the funds listed in subsection (a) have insufficient cash from |
3 | | which the State Comptroller may make expenditures properly |
4 | | supported by appropriations from the fund, then the State |
5 | | Treasurer and State Comptroller shall transfer from the General |
6 | | Revenue Fund to the fund such amount as is immediately |
7 | | necessary to satisfy outstanding expenditure obligations on a |
8 | | timely basis, subject to the provisions of the State Prompt |
9 | | Payment Act.
|
10 | | (c) If the Director of the Governor's Office of Management |
11 | | and Budget determines that any transfer to the General Revenue |
12 | | Fund from a special fund under subsection (a) either (i) |
13 | | jeopardizes federal funding based on a written communication |
14 | | from a federal official or (ii) violates an order of a court of |
15 | | competent jurisdiction, then the Director may order the State |
16 | | Treasurer and State Comptroller, in writing, to transfer from |
17 | | the General Revenue Fund to that listed special fund all or |
18 | | part of the amounts transferred from that special fund under |
19 | | subsection (a). |
20 | | (d) In addition to any other transfers that may be provided |
21 | | for by law, on December 1, 2010, or as soon thereafter as may |
22 | | be practical, the State Comptroller shall direct and the State |
23 | | Treasurer shall transfer the following amounts from the General |
24 | | Revenue Fund to the designated funds: |

6 | | (a) The FY12 Hospital Relief Fund is created as a special |
7 | | fund in the State treasury. Amounts may be expended from the |
8 | | Fund only pursuant to specific authorization by appropriation. |
9 | | (b) Notwithstanding any other State law to the contrary, |
10 | | the State Comptroller shall order transferred and the State |
11 | | Treasurer shall transfer $140,000,000 to the FY12 Hospital |
12 | | Relief Fund from the General Revenue Fund in equal quarterly |
13 | | installments with the first transfer to be made on the |
14 | | effective date of this amendatory Act of the 97th General |
15 | | Assembly, or as soon thereafter as practical, and with each of |
16 | | the remaining transfers to be made on February 1, 2012, April |
17 | | 1, 2012, and June 1, 2012, or as soon thereafter as practical. |

20 | | (a) In addition to any other transfers that may be provided |

7 | | transfer the sum of $25,000,000 from the General Revenue Fund

8 | | to the Fund for Illinois' Future created by Senate Bill 1066 of |
9 | | the 91st
General Assembly. |
10 | | (c) In addition to any other transfers that may be provided |
11 | | for by law,
on August 30 of each fiscal year's license period, |
12 | | the Illinois Liquor Control
Commission shall direct and the |
13 | | State Comptroller and State Treasurer shall
transfer from the |
14 | | General Revenue Fund to the Youth Alcoholism and Substance
|
15 | | Abuse Prevention Fund an amount equal to the number of retail |
16 | | liquor licenses
issued for that fiscal year multiplied by $50. |
17 | | (d) The payments to programs required under subsection (d) |
18 | | of Section 28.1
of the Horse Racing Act of 1975 shall be made, |
19 | | pursuant to appropriation, from
the special funds referred to |
20 | | in the statutes cited in that subsection, rather
than directly |
21 | | from the General Revenue Fund. |
22 | | Beginning January 1, 2000, on the first day of each month, |
23 | | or as soon
as may be practical thereafter, the State |
24 | | Comptroller shall direct and the
State Treasurer shall transfer |
25 | | from the General Revenue Fund to each of the
special funds from |
26 | | which payments are to be made under Section 28.1(d) of the
|

1 | | Horse Racing Act of 1975 an amount equal to 1/12 of the annual |
2 | | amount required
for those payments from that special fund, |

5 | | 1998. The special funds to which transfers shall be made under |
6 | | this
subsection (d) include, but are not necessarily limited |
7 | | to, the Agricultural
Premium Fund; the Metropolitan Exposition |
8 | | Auditorium and Office Building Fund;
the Fair and Exposition |
9 | | Fund; the Standardbred Breeders Fund; the Thoroughbred
|
10 | | Breeders Fund; and the Illinois Veterans' Rehabilitation Fund. |
11 | | (e) In addition to any other transfers that may be provided |
12 | | for by law,
as soon as may be practical after the effective |
13 | | date of this amendatory Act of
the 91st General Assembly, but |
14 | | in no event later than June 30, 2000, the State
Comptroller |
15 | | shall direct and the State Treasurer shall transfer the sum of
|
16 | | $15,000,000 from the General Revenue Fund to the Fund for |
17 | | Illinois' Future. |
18 | | (f) In addition to any other transfers that may be provided |
19 | | for by law,
as soon as may be practical after the effective |
20 | | date of this amendatory Act of
the 91st General Assembly, but |
21 | | in no event later than June 30, 2000, the State
Comptroller |
22 | | shall direct and the State Treasurer shall transfer the sum of

23 | | $70,000,000 from the General Revenue Fund to the Long-Term Care |
24 | | Provider
Fund. |
25 | | (f-1) In fiscal year 2002, in addition to any other |

Comptroller shall direct and the |
13 | | State Treasurer shall transfer $5,000,000
from the General |
14 | | Revenue Fund to the Tourism Promotion Fund. |
15 | | (i) On or after July 1, 2001 and until May 1, 2002, in |
16 | | addition to any
other transfers that may be provided for by |
17 | | law, at the direction of and upon
notification from the |
18 | | Governor, the State Comptroller shall direct and the
State |
19 | | Treasurer shall transfer amounts not exceeding a total of |
20 | | $80,000,000
from the General Revenue Fund to the Tobacco |
21 | | Settlement Recovery Fund.
Any amounts so transferred shall be |

13 | | transfer amounts not exceeding a total of $1,900,000 from the |
14 | | General Revenue Fund to the Illinois Capital Revolving Loan |
15 | | Fund. |
16 | | (gg) In addition to any other transfers that may be |
17 | | provided for by law, on and after July 1, 2006 and until May 1, |
18 | | 2007, at the direction of and upon notification from the |
19 | | Governor, the State Comptroller shall direct and the State |
20 | | Treasurer shall transfer amounts not exceeding a total of |
21 | | $80,000,000 from the General Revenue Fund to the Tobacco |

18 | | proportions. The determination of the amount of the surplus |
19 | | cash balance shall be made by the Governor, with the |
20 | | concurrence of the State Comptroller, after taking into account |
21 | | the June 30, 2006 balances in the general funds and the actual |
22 | | or estimated spending from the general funds during the lapse |
23 | | period. Notwithstanding the foregoing, the maximum amount that |
24 | | may be transferred under this subsection (ii) is $50,000,000. |
25 | | (jj) In addition to any other transfers that may be |
26 | | provided for by law, on July 1, 2006, or as soon thereafter as |

12 | | of the fiscal year beginning July 1, 2006, or as soon |
13 | | thereafter as practical, the State Comptroller shall direct and |
14 | | the State Treasurer shall transfer from the General Revenue |
15 | | Fund amounts equal to one-fourth of $20,000,000 to the |
16 | | Renewable Energy Resources Trust Fund. |
17 | | (mm) In addition to any other transfers that may be |
18 | | provided for by law, on July 1, 2006, or as soon thereafter as |
19 | | practical, the State Comptroller shall direct and the State |
20 | | Treasurer shall transfer the sum of $1,320,000 from the General |
21 | | Revenue Fund to the I-FLY Fund. |
22 | | (nn) In addition to any other transfers that may be |
23 | | provided for by law, on July 1, 2006, or as soon thereafter as |
24 | | practical, the State Comptroller shall direct and the State |
25 | | Treasurer shall transfer the sum of $3,000,000 from the General |
26 | | Revenue Fund to the African-American HIV/AIDS Response Fund. |

1 | | (oo) In addition to any other transfers that may be |
2 | | provided for by law, on and after July 1, 2006 and until June |

5 | | Treasurer shall transfer amounts identified as net receipts |
6 | | from the sale of all or part of the Illinois Student Assistance |
7 | | Commission loan portfolio from the Student Loan Operating Fund |
8 | | to the General Revenue Fund. The maximum amount that may be |
9 | | transferred pursuant to this Section is $38,800,000. In |
10 | | addition, no transfer may be made pursuant to this Section that |
11 | | would have the effect of reducing the available balance in the |
12 | | Student Loan Operating Fund to an amount less than the amount |
13 | | remaining unexpended and unreserved from the total |
14 | | appropriations from the Fund estimated to be expended for the |
15 | | fiscal year. The State Treasurer and Comptroller shall transfer |
16 | | the amounts designated under this Section as soon as may be |
17 | | practical after receiving the direction to transfer from the |
18 | | Governor.

In addition to any other transfers that may be |
20 | | provided for by law, on July 1, 2006, or as soon thereafter as |

12 | | (d) For the purposes of this Article, beginning in fiscal |
13 | | year 2009 the General Assembly shall appropriate
an amount from |
14 | | the Downstate Public Transportation Fund equal to the sum total |
15 | | funds projected to be paid to the
participants pursuant to |
16 | | Section 2-7. If the General Assembly fails to make |
17 | | appropriations sufficient to cover the amounts projected to be |
18 | | paid pursuant to Section 2-7, this Act shall constitute an |
19 | | irrevocable and continuing appropriation from the Downstate |
20 | | Public Transportation Fund of all amounts necessary for those |
21 | | purposes. |
22 | | (e) Notwithstanding anything in this Section to the |
23 | | contrary, amounts transferred from the General Revenue Fund to |
24 | | the Downstate Public Transportation Fund pursuant to this |
25 | | Section shall not exceed $169,000,000 in State fiscal year |
26 | | 2012.

12 | | Service Boards as follows: 15% of such moneys shall be retained |
13 | | by the Authority and the remaining 85% shall be transferred to |
14 | | the Service Boards as soon as may be practicable after the |
15 | | Authority receives payment. Moneys which are distributable to |
16 | | the Service Boards pursuant to the preceding sentence shall be |
17 | | allocated among the Service Boards on the basis of each Service |
18 | | Board's distribution ratio. The term "distribution ratio" |
19 | | means, for purposes of this subsection (b), the ratio of the |
20 | | total amount distributed to a Service Board pursuant to |
21 | | subsection (a) of Section 4.03.3 for the immediately preceding |
22 | | calendar year to the total amount distributed to all of the |
23 | | Service Boards pursuant to subsection (a) of Section 4.03.3 for |
24 | | the immediately preceding calendar year.

25 | | (c)(i) 20% of the receipts from those taxes collected in |
26 | | Cook County under Section 4.03 at the rate of 1.25%, (ii) 25% |

1 | | of the receipts from those taxes collected in Cook County under |
2 | | Section 4.03 at the rate of 1%, (iii) 50% of the receipts from |
3 | | those taxes collected in DuPage, Kane, Lake, McHenry, and Will |
4 | | Counties under Section 4.03, and (iv) amounts received from the |
5 | | State under Section 4.09 (a)(2) and items (i), (ii), and (iii) |
6 | | of Section 4.09 (a)(3) shall be allocated as follows: the |
7 | | amount required to be deposited into the ADA Paratransit Fund |
8 | | described in Section 2.01d, the amount required to be deposited |
9 | | into the Suburban Community Mobility Fund described in Section |
10 | | 2.01e, and the amount required to be deposited into the |
11 | | Innovation, Coordination and Enhancement Fund described in |
12 | | Section 2.01c, and the balance shall be allocated 48% to the |
13 | | Chicago Transit Authority, 39% to the Commuter Rail Board, and |
14 | | 13% to the Suburban Bus Board.

15 | | (d) Amounts received from the State under Section 4.09 |
16 | | (a)(3)(iv) shall be distributed 100% to the Chicago Transit |
17 | | Authority.
|
18 | | (e) With respect to those taxes collected in DuPage, Kane, |
19 | | Lake, McHenry, and Will Counties and paid directly to the |
20 | | counties under Section 4.03, the County Board of each county |
21 | | shall use those amounts to fund operating and capital costs of |
22 | | public safety and public transportation services or facilities |
23 | | or to fund operating, capital, right-of-way, construction, and |
24 | | maintenance costs of other transportation purposes, including |
25 | | road, bridge, public safety, and transit purposes intended to |
26 | | improve mobility or reduce congestion in the county. The |

1 | | receipt of funding by such counties pursuant to this paragraph |
2 | | shall not be used as the basis for reducing any funds that such |
3 | | counties would otherwise have received from the State of |
4 | | Illinois, any agency or instrumentality thereof, the |
5 | | Authority, or the Service Boards.
|
6 | | (f) The Authority by ordinance adopted by 12 of its then |
7 | | Directors shall apportion to the Service Boards funds provided |
8 | | by the State of Illinois under Section 4.09(a)(1) as it shall |
9 | | determine and shall make payment of the amounts to each Service |
10 | | Board as soon as may be practicable upon their receipt provided |
11 | | the Authority has adopted a balanced budget as required by |
12 | | Section 4.01 and further provided the Service Board is in |
13 | | compliance with the requirements in Section 4.11.
|
14 | | (g) Beginning January 1, 2009, before making any payments, |
15 | | transfers, or expenditures under this Section to a Service |
16 | | Board, the Authority must first comply with Section 4.02a or |
17 | | 4.02b of this Act, whichever may be applicable.
|
18 | | (h) Moneys may be appropriated from the Public |
19 | | Transportation Fund to the Office of the Executive Inspector |
20 | | General for the costs incurred by the Executive Inspector |
21 | | General while serving as the inspector general for the |
22 | | Authority and each of the Service Boards. Beginning December |
23 | | 31, 2012, and each year thereafter, the Office of the Executive |
24 | | Inspector General shall annually report to the General Assembly |
25 | | the expenses incurred while serving as the inspector general |
26 | | for the Authority and each of the Service Boards.

2 | | Section 25. The School Code is amended by changing Section |
3 | | 27A-7.5 as follows: |

5 | | Sec. 27A-7.5. State Charter School Commission. |
6 | | (a) A State Charter School Commission is established as an |
7 | | independent State agency with statewide chartering |
8 | | jurisdiction and authority. |
9 | | (b) The Commission is responsible for authorizing |
10 | | high-quality charter schools throughout this State, |
11 | | particularly schools designed to expand opportunities for |
12 | | at-risk students, consistent with the purposes of this Article. |
13 | | (c) The Commission shall consist of 9 members, appointed by |
14 | | the State Board. The State Board shall make these appointments |
15 | | from a slate of candidates proposed by the Governor, within 60 |
16 | | days after the effective date of this amendatory Act of the |
17 | | 97th General Assembly with respect to the initial Commission |
18 | | members. In making the appointments, the State Board shall |
19 | | ensure statewide geographic diversity among Commission |
20 | | members. The Governor shall propose a slate of candidates to |
21 | | the State Board within 60 days after the effective date of this |
22 | | amendatory Act of the 97th General Assembly and 60 days prior |
23 | | to the expiration of the term of a member thereafter. If the |
24 | | Governor fails to timely propose a slate of candidates |

1 | | according to the provisions of this subsection (c), then the |
2 | | State Board may appoint the member or members of the |
3 | | Commission. |
4 | | (d) Members appointed to the Commission shall collectively |
5 | | possess strong experience and expertise in public and nonprofit |
6 | | governance, management and finance, public school leadership, |
7 | | higher education, assessments, curriculum and instruction, and |
8 | | public education law. All members of the Commission shall have |
9 | | demonstrated understanding of and a commitment to public |
10 | | education, including without limitation charter schooling. At |
11 | | least 3 members must have past experience with urban charter |
12 | | schools. |
13 | | (e) To establish staggered terms of office, the initial |
14 | | term of office for 3 Commission members shall be 4 years and |
15 | | thereafter shall be 4 years; the initial term of office for |
16 | | another 3 members shall be 3 years and thereafter shall be 4 |
17 | | years; and the initial term of office for the remaining 3 |
18 | | members shall be 2 years and thereafter shall be 4 years. The |
19 | | initial appointments must be made no later than October 1, |
20 | | 2011. |
21 | | (f) Whenever a vacancy on the Commission exists, the State |
22 | | Board shall appoint a member for the remaining portion of the |
23 | | term. |
24 | | (g) Subject to the State Officials and Employees Ethics |
25 | | Act, the Commission is authorized to receive and expend gifts, |
26 | | grants, and donations of any kind from any public or private |

1 | | entity to carry out the purposes of this Article, subject to |
2 | | the terms and conditions under which they are given, provided |
3 | | that all such terms and conditions are permissible under law. |
4 | | Funds received under this subsection (g) must be deposited into |
5 | | the State Charter School Commission Fund. |
6 | | The State Charter School Commission Fund is created as a |
7 | | special fund in the State treasury. All money in the Fund shall |
8 | | be used, subject to appropriation, by the Commission for |
9 | | operational and administrative costs of the Commission. |
10 | | Subject to appropriation, any funds appropriated for use by |
11 | | the State Charter School Commission may be used for the |
12 | | following purposes, without limitation: personal services, |
13 | | contractual services, and other operational and administrative |
14 | | costs. The State Charter School Commission is further |
15 | | authorized to make expenditures with respect to any other |
16 | | amounts deposited in accordance with law into the State Charter |
17 | | School Commission Fund. |
18 | | (h) The Commission shall operate with dedicated resources |
19 | | and staff qualified to execute the day-to-day responsibilities |
20 | | of charter school authorizing in accordance with this Article. |
21 | | (i) Every 2 years, the Commission shall provide to the |
22 | | State Board and local school boards a report on best practices |
23 | | in charter school authorizing, including without limitation |
24 | | evaluating applications, oversight of charters, and renewal of |
25 | | charter schools. |
26 | | (j) The Commission may charge a charter school that it |

1 | | authorizes a fee, not to exceed 3% of the revenue provided to |
2 | | the school, to cover the cost of undertaking the ongoing |
3 | | administrative responsibilities of the eligible chartering |
4 | | authority with respect to the school. This fee must be |
5 | | deposited into the State Charter School Commission Fund. |
6 | | (k) Any charter school authorized by the State Board prior |
7 | | to this amendatory Act of the 97th General Assembly shall have |
8 | | its authorization transferred to the Commission upon a vote of |
9 | | the State Board, which shall then become the school's |
10 | | authorizer for all purposes under this Article. However, in no |
11 | | case shall such transfer take place later than July 1, 2012. At |
12 | | this time, all of the powers, duties, assets, liabilities, |
13 | | contracts, property, records, and pending business of the State |
14 | | Board as the school's authorizer must be transferred to the |
15 | | Commission. Any charter school authorized by a local school |
16 | | board or boards may seek transfer of authorization to the |
17 | | Commission during its current term only with the approval of |
18 | | the local school board or boards. At the end of its charter |
19 | | term, a charter school authorized by a local school board or |
20 | | boards must reapply to the board or boards before it may apply |
21 | | for authorization to the Commission under the terms of this |
22 | | amendatory Act of the 97th General Assembly. |
23 | | On the effective date of this amendatory Act of the 97th |
24 | | General Assembly, all rules of the State Board applicable to |
25 | | matters falling within the responsibility of the Commission |
26 | | shall be applicable to the actions of the Commission. The |

1 | | Commission shall thereafter have the authority to propose to |
2 | | the State Board modifications to all rules applicable to |
3 | | matters falling within the responsibility of the Commission. |
4 | | The State Board shall retain rulemaking authority for the |
5 | | Commission, but shall work jointly with the Commission on any |
6 | | proposed modifications. Upon recommendation of proposed rule |
7 | | modifications by the Commission and pursuant to the Illinois |
8 | | Administrative Procedure Act, the State Board shall consider |
9 | | such changes within the intent of this amendatory Act of the |
10 | | 97th General Assembly and grant any and all changes consistent |
11 | | with that intent. |
12 | | (l) The Commission shall have the responsibility to |
13 | | consider appeals under this Article immediately upon |
14 | | appointment of the initial members of the Commission under |
15 | | subsection (c) of this Section. Appeals pending at the time of |
16 | | initial appointment shall be determined by the Commission; the |
17 | | Commission may extend the time for review as necessary for |
18 | | thorough review, but in no case shall the extension exceed the |
19 | | time that would have been available had the appeal been |
20 | | submitted to the Commission on the date of appointment of its |
21 | | initial members. In any appeal filed with the Commission under |
22 | | this Article, both the applicant and the school district in |
23 | | which the charter school plans to locate shall have the right |
24 | | to request a hearing before the Commission. If more than one |
25 | | entity requests a hearing, then the Commission may hold only |
26 | | one hearing, wherein the applicant and the school district |

15 | | ethics and professional responsibility; and (4) a continuum of |
16 | | trial advocacy
techniques and methods , including an emphasis on |
17 | | the elimination of or reduction in of eliminating or reducing |
18 | | the trauma of
testifying in criminal proceedings for vulnerable |
19 | | populations including seniors, disabled persons, and children |
20 | | who serve as witnesses in
such proceedings. The Office may make |
21 | | grants for these purposes. In addition, the Office may
publish, |
22 | | disseminate
and sell publications and newsletters which digest |
23 | | current Appellate and
Supreme Court cases and legislative |
24 | | developments of importance to prosecutors
and law enforcement |
