| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Public Aid Code is amended by |
| 5 | | changing Section 5-2.1a as follows:

| 6 | | (305 ILCS 5/5-2.1a)

| 7 | | Sec. 5-2.1a. Treatment of trust amounts. To the
the extent |
| 8 | | required by
federal
law, the Illinois Department shall provide |
| 9 | | by rule for the consideration of
trusts and similar legal |
| 10 | | instruments or devices established by a person in the
Illinois |
| 11 | | Department's determination of the person's eligibility for and |
| 12 | | the
amount of assistance provided under this Article.
This |
| 13 | | Section shall be enforced by the Department of Human Services, |
| 14 | | acting as
successor to the Department of Public Aid under the |
| 15 | | Department of Human
Services Act. |
