Three directors appointed by the members of the |

13 | | a majority of the residents of which
reside outside |
14 | | Chicago. In either case, such appointment shall be with

15 | | concurrence of four such Commissioners. Each such director |

in that part of Cook County outside Chicago.

One director appointed by the Mayor of the City of |
18 | | Chicago, with the
advice and consent of the City Council of |
19 | | the City of Chicago. Such director
shall reside in the City |
20 | | of Chicago.

21 | | (5) The chairman shall be appointed by the directors, |
22 | | from the members of
the board, with the concurrence of 5 of |
23 | | such directors.

24 | | (b) Until 30 days after the effective date of this |
25 | | amendatory Act of the 97th General Assembly, After April 1, |
26 | | 2008 the governing body of the Commuter Rail Division shall be |

1 | | a board consisting of 11 directors appointed, pursuant to |
2 | | Sections 3B.03 and 3B.04, as follows:

3 | | (1) One Director shall be appointed by the Chairman of |
4 | | the DuPage County Board with the advice and consent of the |
5 | | DuPage County Board and shall reside in DuPage County. To |
6 | | implement the changes in appointing authority under this |
7 | | Section, upon the expiration of the term of or vacancy in |
8 | | office of the Director appointed under item (1) of |
9 | | subsection (a) of this Section who resides in DuPage |
10 | | County, a Director shall be appointed under this |
11 | | subparagraph.

12 | | (2) One Director shall be appointed by the Chairman of |
13 | | the McHenry County Board with the advice and consent of the |
14 | | McHenry County Board and shall reside in McHenry County. To |
15 | | implement the change in appointing authority under this |
16 | | Section, upon the expiration of the term of or vacancy in |
17 | | office of the Director appointed under item (2) of |
18 | | subsection (a) of this Section who resides in McHenry |
19 | | County, a Director shall be appointed under this |
20 | | subparagraph.

21 | | (3) One Director shall be appointed by the Will County |
22 | | Executive with the advice and consent of the Will County |
23 | | Board and shall reside in Will County. To implement the |
24 | | change in appointing authority under this Section, upon the |
25 | | expiration of the term of or vacancy in office of the |
26 | | Director appointed under item (2) of subsection (a) of this |

1 | | Section who resides in Will County, a Director shall be |
2 | | appointed under this subparagraph.

3 | | (4) One Director shall be appointed by the Chairman of |
4 | | the Lake County Board with the advice and consent of the |
5 | | Lake County Board and shall reside in Lake County.
|
6 | | (5) One Director shall be appointed by the Chairman of |
7 | | the Kane County Board with the advice and consent of the |
8 | | Kane County Board and shall reside in Kane County.
|
9 | | (6) One Director shall be appointed by the Mayor of the |
10 | | City of Chicago with the advice and consent of the City |
11 | | Council of the City of Chicago and shall reside in the City |
12 | | of Chicago. To implement the changes in appointing |
13 | | authority under this Section, upon the expiration of the |
14 | | term of or vacancy in office of the Director appointed |
15 | | under item (4) of subsection (a) of this Section who |
16 | | resides in the City of Chicago, a Director shall be |
17 | | appointed under this subparagraph.

18 | | (7) Five Directors residing in Cook County outside of |
19 | | the City of Chicago, as follows: |
20 | | (i) One Director who resides in Cook County outside |
21 | | of the City of Chicago, appointed by the President of |
22 | | the Cook County Board with the advice and consent of |
23 | | the members of the Cook County Board. |
24 | | (ii) One Director who resides in the township of |
25 | | Barrington, Palatine, Wheeling, Hanover, Schaumburg, |
26 | | or Elk Grove. To implement the changes in appointing |

1 | | authority under this Section, upon the expiration of |
2 | | the term of or vacancy in office of the Director |
3 | | appointed under paragraph (3) of subsection (a) of this |
4 | | Section who resides in the geographic area described in |
5 | | this subparagraph, a Director shall be appointed under |
6 | | this subparagraph. |
7 | | (iii) One Director who resides in the township of |
8 | | Northfield, New Trier, Maine, Niles, Evanston, Leyden, |
9 | | Norwood Park, River Forest, or Oak Park. |
10 | | (iv) One Director who resides in the township of |
11 | | Proviso, Riverside, Berwyn, Cicero, Lyons, Stickney, |
12 | | Lemont, Palos, or Orland. To implement the changes in |
13 | | appointing authority under this Section, upon the |
14 | | expiration of the term of or vacancy in office of the |
15 | | Director appointed under paragraph (3) of subsection |
16 | | (a) of this Section who resides in the geographic area |
17 | | described in this subparagraph and whose term of office |
18 | | had not expired as of August 1, 2007, a Director shall |
19 | | be appointed under this subparagraph. |
20 | | (v) One Director who resides in the township of |
21 | | Worth, Calumet, Bremen, Thornton, Rich, or Bloom. To |
22 | | implement the changes in appointing authority under |
23 | | this Section, upon the expiration of the term of or |
24 | | vacancy in office of the Director appointed under |
25 | | paragraph (3) of subsection (a) of this Section who |
26 | | resides in the geographic area described in this |

1 | | subparagraph and whose term of office had expired as of |
2 | | August 1, 2007, a Director shall be appointed under |
3 | | this subparagraph. |
4 | | (vi) The Directors identified under the provisions |
5 | | of subparagraphs (ii) through (v) of this paragraph (7) |
6 | | shall be appointed by the members of the Cook County |
7 | | Board. Each individual Director shall be appointed by |
8 | | those members of the Cook County Board whose Board |
9 | | districts overlap in whole or in part with the |
10 | | geographic territory described in the relevant |
11 | | subparagraph. The vote of County Board members |
12 | | eligible to appoint directors under the provisions of |
13 | | subparagraphs (ii) through (v) of this paragraph (7) |
14 | | shall be weighted by the number of electors residing in |
15 | | those portions of their Board districts within the |
16 | | geographic territory described in the relevant |
17 | | subparagraph (ii) through (v) of this paragraph (7).

18 | | (8) The Chairman shall be appointed by the Directors, |
19 | | from the members of the Board, with the concurrence of 8 of |
20 | | such Directors. To implement the changes in appointing |
21 | | authority under this Section, upon the expiration of the |
22 | | term of or vacancy in office of the Chairman appointed |
23 | | under item (5) of subsection (a) of this Section, a |
24 | | Chairman shall be appointed under this subparagraph.

25 | | (b-5) Notwithstanding any provision of this Article to the |
26 | | contrary, the term of office of each Director serving on the |
|

1 | | effective date of this amendatory Act of the 97th General |
2 | | Assembly expires on the date that occurs 30 calendar days after |
3 | | the effective date of this amendatory Act of the 97th General |
4 | | Assembly. Beginning 31 calendar days after the effective date |
5 | | of this amendatory Act of the 97th General Assembly, the |
6 | | governing body of the Commuter Rail Division shall be a board |
7 | | consisting of 11 directors appointed, pursuant to this |
8 | | subsection (b-5) and Sections 3B.03 and 3B.04, as follows: |
9 | | (1) One Director shall be appointed by the Chairman of |
10 | | the DuPage County Board with the advice and consent of the |
11 | | DuPage County Board and shall reside in DuPage County. |
12 | | (2) One Director shall be appointed by the Chairman of |
13 | | the McHenry County Board with the advice and consent of the |
14 | | McHenry County Board and shall reside in McHenry County. |
15 | | (3) One Director shall be appointed by the Will County |
16 | | Executive with the advice and consent of the Will County |
17 | | Board and shall reside in Will County. |
18 | | (4) One Director shall be appointed by the Chairman of |
19 | | the Lake County Board with the advice and consent of the |
20 | | Lake County Board and shall reside in Lake County. |
21 | | (5) One Director shall be appointed by the Chairman of |
22 | | the Kane County Board with the advice and consent of the |
23 | | Kane County Board and shall reside in Kane County. |
24 | | (6) One Director shall be appointed by the Mayor of the |
25 | | City of Chicago with the advice and consent of the City |
26 | | Council of the City of Chicago and shall reside in the City |

1 | | of Chicago. |
2 | | (7) Five Directors shall reside in Cook County outside |
3 | | of the City of Chicago, as follows: |
4 | | (i) One Director who resides in Cook County outside |
5 | | of the City of Chicago, appointed by the President of |
6 | | the Cook County Board with the advice and consent of |
7 | | the members of the Cook County Board, except that for |
8 | | the initial term, the Director may be replaced by the |
9 | | President of the Cook County Board, with the advice and |
10 | | consent of the members of the Cook County Board, no |
11 | | sooner than January 15, 2011. |
12 | | (ii) One Director who resides in the township of |
13 | | Barrington, Palatine, Wheeling, Hanover, Schaumburg, |
14 | | or Elk Grove. |
15 | | (iii) One Director who resides in the township of |
16 | | Northfield, New Trier, Maine, Niles, Evanston, Leyden, |
17 | | Norwood Park, River Forest, or Oak Park. |
18 | | (iv) One Director who resides in the township of |

5 | | subparagraphs (ii) through (v) of this paragraph (7) shall |
6 | | be weighted by the number of electors residing in those |
7 | | portions of their Board districts within the geographic |
8 | | territory described in the relevant subparagraph (ii) |
9 | | through (v) of this paragraph (7). |
10 | | (c) No director, while serving as such, shall be an |
11 | | officer, a member of the
board of directors or trustee or an |
12 | | employee of any transportation agency,
or be an employee of the |
13 | | State of Illinois or any department or agency thereof,
or of |
14 | | any unit of local government or receive any compensation from |
15 | | any
elected or appointed office under the Constitution and laws |
16 | | of Illinois.

17 | | (d) Each appointment made under subsections (a) and (b) of |
18 | | this Section
and under Section
3B.03 shall be certified by the |
19 | | appointing authority to the Commuter Rail Board
which shall |
20 | | maintain the certifications as part of the official records
of |
21 | | the Commuter Rail Board.

23 | | Section 99. Effective date. This Act takes effect upon |
24 | | becoming law.".
