1 | | adopted township organization, or upon ordinance or resolution |
2 | | adopted by the township board, the township board shall certify |
3 | | and cause to be submitted to the voters of the township, at the |
4 | | next election, the question of the continuance of the office of |
5 | | Highway Commissioner. A signature on a petition shall not be |
6 | | valid or counted in considering the petition unless the form |
7 | | requirements are complied with and the date of each signature |
8 | | is less than 90 days before the last day for filing the |
9 | | petition. The statement of the person who circulates the |
10 | | petition must include an attestation (i) indicating the dates |
11 | | on which that sheet was circulated, (ii) indicating the first |
12 | | and last date on which that sheet was circulated, or (iii) |
13 | | certifying that none of the signatures on the sheet was signed |
14 | | more than 90 days before the last day for filing the petition. |
15 | | The petition shall be treated and the proposition certified in |
16 | | the manner provided by the general election law. |
17 | | The proposition shall be in substantially the following |
18 | | form: |
19 | | Shall the office of Highway Commissioner be continued |
20 | | in (name of township)? |
21 | | The votes shall be recorded as "Yes" or "No". |

23 | | Sec. 27-10. Cessation of offices in a township. If a |
24 | | majority of the votes of the township cast on the question of |
25 | | the continuance of the office of Highway Commissioner at the |

1 | | election are against the proposed option for continuance, then |
2 | | the office of Highway Commissioner shall cease in the township |
3 | | at the end of the current term of office. If the office of the |
4 | | Highway Commissioner ceases, then the county superintendent of |
5 | | highways or the county engineer, as applicable, shall assume |
6 | | the duties of Highway Commissioner under the Illinois Highway |
7 | | Code. |

9 | | Sec. 27-15. Township assets. If the office of Highway |
10 | | Commissioner is discontinued, then the assets of that office |
11 | | shall be appraised and distributed equally between the county |
12 | | and the township.

13 | | Section 10. The Illinois Highway Code is amended by adding |
14 | | Section 5-205.10 as follows: |

16 | | Sec. 5-205.10. Cessation of township Highway Commissioner. |
17 | | If the office of Highway Commissioner ceases as provided in |
18 | | Article 27 of the Township Code, then the county superintendent |
19 | | of highways or the county engineer, as applicable, shall assume |
20 | | the duties of Highway Commissioner under this Code.

21 | | Section 99. Effective date. This Act takes effect upon |
22 | | becoming law.".
