AMENDMENT TO SENATE BILL 3778

2    AMENDMENT NO. ______. Amend Senate Bill 3778, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Downstate Public Transportation Act is
6amended by changing Section 2-15.2 as follows:
 
7    (30 ILCS 740/2-15.2)
8    Sec. 2-15.2. Free services; eligibility.
9    (a) (Blank). Notwithstanding any law to the contrary, no
10later than 60 days following the effective date of this
11amendatory Act of the 95th General Assembly, any fixed route
12public transportation services provided by, or under grant or
13purchase of service contracts of, every participant, as defined
14in Section 2-2.02 (1)(a), shall be provided without charge to
15all senior citizen residents of the participant aged 65 and
16older, under such conditions as shall be prescribed by the

1participant.
2    (b) Notwithstanding any law to the contrary, on or after
3the effective date of this amendatory Act of the 96th General
4Assembly, any fixed route public transportation services
5provided by, or under grant or purchase of service contracts
6of, every participant, as defined in Section 2-2.02 (1)(a),
7shall be provided without charge to any person aged 65 or older
8who meets the income eligibility limitation set forth in
9subsection (a-5) of Section 4 of the Senior Citizens and
10Disabled Persons Property Tax Relief and Pharmaceutical
11Assistance Act, under such conditions as shall be prescribed by
12the participant. The Department on Aging shall furnish all
13information reasonably necessary to determine eligibility,
14including updated lists of individuals who are eligible for
15services without charge under this Section.
16    (c) In addition, any fixed route public transportation
17services shall also be provided free of charge to any person
18aged 65 or older who possesses a valid fare card or other form
19of verification issued by the participant that authorizes the
20person to receive free services on or before the effective date
21of this amendatory Act of the 96th General Assembly. If a
22person meets the requirements of this subsection, then the
23person may continue to receive free services until the
24expiration date on the fare card or other form of verification.
25If a person meets the requirements of this subsection but the
26valid fare card or other form of verification does not have an

1expiration date, then the person may continue to receive free
2services for 4 years after the effective date of this
3amendatory Act of the 96th General Assembly. This subsection
4applies to persons aged 65 or older who do not qualify under
5subsection (b).
6    (d) Nothing in this Section shall relieve the participant
7from providing reduced fares as may be required by federal law.

9    Section 10. The Metropolitan Transit Authority Act is
10amended by changing Section 51 as follows:

12    Sec. 51. Free services; eligibility.
13    (a) (Blank). Notwithstanding any law to the contrary, no
14later than 60 days following the effective date of this
15amendatory Act of the 95th General Assembly, any fixed route
16public transportation services provided by, or under grant or
17purchase of service contracts of, the Board shall be provided
18without charge to all senior citizens of the Metropolitan
19Region (as such term is defined in 70 ILCS 3615/1.03) aged 65
20and older, under such conditions as shall be prescribed by the
21Board.
22    (b) Notwithstanding any law to the contrary, on or after
23the effective date of this amendatory Act of the 96th General
24Assembly, any fixed route public transportation services

1provided by, or under grant or purchase of service contracts
2of, the Board shall be provided without charge to any person
3aged 65 or older who meets the income eligibility limitation
4set forth in subsection (a-5) of Section 4 of the Senior
5Citizens and Disabled Persons Property Tax Relief and
6Pharmaceutical Assistance Act, under such conditions as shall
7be prescribed by the Board. The Department on Aging shall
8furnish all information reasonably necessary to determine
9eligibility, including updated lists of individuals who are
10eligible for services without charge under this Section.
11    (c) In addition, any fixed route public transportation
12services shall also be provided free of charge to any person

15Regional Transportation Authority that authorizes the person
16to receive free services on or before the effective date of
17this amendatory Act of the 96th General Assembly. If a person
18meets the requirements of this subsection, then the person may
19continue to receive free services until the expiration date on
20the fare card or other form of verification. If a person meets
21the requirements of this subsection but the valid fare card or
22other form of verification does not have an expiration date,
23then the person may continue to receive free services for 4
24years after the effective date of this amendatory Act of the
2596th General Assembly. This subsection applies to persons aged
2665 or older who do not qualify under subsection (b).

4    Section 15. The Local Mass Transit District Act is amended
5by changing Section 8.6 as follows:

7    Sec. 8.6. Free services; eligibility.
8    (a) (Blank). Notwithstanding any law to the contrary, no
9later than 60 days following the effective date of this
10amendatory Act of the 95th General Assembly, any fixed route
11public transportation services provided by, or under grant or
12purchase of service contracts of, every District shall be
13provided without charge to all senior citizens of the District
14aged 65 and older, under such conditions as shall be prescribed
15by the District.
16    (b) Notwithstanding any law to the contrary, on or after
17the effective date of this amendatory Act of the 96th General
18Assembly, any fixed route public transportation services
19provided by, or under grant or purchase of service contracts
20of, every District shall be provided without charge to any
21person aged 65 or older who meets the income eligibility
22limitation set forth in subsection (a-5) of Section 4 of the
23Senior Citizens and Disabled Persons Property Tax Relief and

7purchase of service contracts of, the Suburban Bus Board shall
8be provided without charge to all senior citizens of the
9Metropolitan Region aged 65 and older, under such conditions as
10shall be prescribed by the Suburban Bus Board.
11    (b) Notwithstanding any law to the contrary, on or after
12the effective date of this amendatory Act of the 96th General
13Assembly, any fixed route public transportation services
14provided by, or under grant or purchase of service contracts
15of, the Suburban Bus Board shall be provided without charge to
16any person aged 65 or older who meets the income eligibility
17limitation set forth in subsection (a-5) of Section 4 of the
18Senior Citizens and Disabled Persons Property Tax Relief and
19Pharmaceutical Assistance Act, under such conditions as shall
20be prescribed by the Suburban Bus Board. The Department on
21Aging shall furnish all information reasonably necessary to
22determine eligibility, including updated lists of individuals
23who are eligible for services without charge under this
24Section.

3Metropolitan Region aged 65 and older, under such conditions as
4shall be prescribed by the Commuter Rail Board.
5    (b) Notwithstanding any law to the contrary, on or after
6the effective date of this amendatory Act of the 96th General
7Assembly, any fixed route public transportation services
8provided by, or under grant or purchase of service contracts
9of, the Commuter Rail Board shall be provided without charge to
10any person aged 65 or older who meets the income eligibility
11limitation set forth in subsection (a-5) of Section 4 of the
12Senior Citizens and Disabled Persons Property Tax Relief and
13Pharmaceutical Assistance Act, under such conditions as shall
14be prescribed by the Commuter Rail Board. The Department on
15Aging shall furnish all information reasonably necessary to
16determine eligibility, including updated lists of individuals
17who are eligible for services without charge under this
18Section.
19    (c) In addition, any fixed route public transportation
20services shall also be provided free of charge to any person
21aged 65 or older who possesses a valid fare card or other form

13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
