AMENDMENT TO SENATE BILL 3778

2    AMENDMENT NO. ______. Amend Senate Bill 3778 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Downstate Public Transportation Act is
5amended by changing Section 2-15.2 as follows:
 
6    (30 ILCS 740/2-15.2)
7    Sec. 2-15.2. Free services; eligibility.
8    (a) Notwithstanding any law to the contrary, no later than
960 days following the effective date of this amendatory Act of
10the 95th General Assembly and until subsection (b) is
11implemented, any fixed route public transportation services
12provided by, or under grant or purchase of service contracts
13of, every participant, as defined in Section 2-2.02 (1)(a),
14shall be provided without charge to all senior citizen
15residents of the participant aged 65 and older, under such
16conditions as shall be prescribed by the participant.

1    (b) Notwithstanding any law to the contrary, no later than
2180 days following the effective date of this amendatory Act of
3the 96th General Assembly, any fixed route public
4transportation services provided by, or under grant or purchase
5of service contracts of, every participant, as defined in
6Section 2-2.02 (1)(a), shall be provided without charge to
7senior citizens aged 65 and older who meet the income
8eligibility limitation set forth in subsection (a-5) of Section
94 of the Senior Citizens and Disabled Persons Property Tax
10Relief and Pharmaceutical Assistance Act, under such
11conditions as shall be prescribed by the participant. The
12Department on Aging shall furnish all information reasonably
13necessary to determine eligibility, including updated lists of
14individuals who are eligible for services without charge under
15this Section. Nothing in this Section shall relieve the
16participant from providing reduced fares as may be required by
17federal law.

19    Section 10. The Metropolitan Transit Authority Act is
20amended by changing Section 51 as follows:

22    Sec. 51. Free services; eligibility.
23    (a) Notwithstanding any law to the contrary, no later than
2460 days following the effective date of this amendatory Act of

1the 95th General Assembly and until subsection (b) is
2implemented, any fixed route public transportation services
3provided by, or under grant or purchase of service contracts
4of, the Board shall be provided without charge to all senior
5citizens of the Metropolitan Region (as such term is defined in
670 ILCS 3615/1.03) aged 65 and older, under such conditions as
7shall be prescribed by the Board.
8    (b) Notwithstanding any law to the contrary, no later than
9180 days following the effective date of this amendatory Act of
10the 96th General Assembly, any fixed route public
11transportation services provided by, or under grant or purchase
12of service contracts of, the Board shall be provided without
13charge to senior citizens aged 65 and older who meet the income
14eligibility limitation set forth in subsection (a-5) of Section
154 of the Senior Citizens and Disabled Persons Property Tax
16Relief and Pharmaceutical Assistance Act, under such
17conditions as shall be prescribed by the Board. The Department
18on Aging shall furnish all information reasonably necessary to
19determine eligibility, including updated lists of individuals
20who are eligible for services without charge under this
21Section. Nothing in this Section shall relieve the Board from
22providing reduced fares as may be required by federal law.

24    Section 15. The Local Mass Transit District Act is amended
25by changing Section 8.6 as follows:

2    Sec. 8.6. Free services; eligibility.
3    (a) Notwithstanding any law to the contrary, no later than
460 days following the effective date of this amendatory Act of
5the 95th General Assembly and until subsection (b) is
6implemented, any fixed route public transportation services
7provided by, or under grant or purchase of service contracts
8of, every District shall be provided without charge to all
9senior citizens of the District aged 65 and older, under such
10conditions as shall be prescribed by the District.
11    (b) Notwithstanding any law to the contrary, no later than
12180 days following the effective date of this amendatory Act of
13the 96th General Assembly, any fixed route public
14transportation services provided by, or under grant or purchase
15of service contracts of, every District shall be provided
16without charge to senior citizens aged 65 and older who meet
17the income eligibility limitation set forth in subsection (a-5)
18of Section 4 of the Senior Citizens and Disabled Persons
19Property Tax Relief and Pharmaceutical Assistance Act, under
20such conditions as shall be prescribed by the District. The
21Department on Aging shall furnish all information reasonably
22necessary to determine eligibility, including updated lists of
23individuals who are eligible for services without charge under
24this Section. Nothing in this Section shall relieve the

3    Section 20. The Regional Transportation Authority Act is
4amended by changing Sections 3A.15 and 3B.14 as follows:

6    Sec. 3A.15. Free services; eligibility.
7    (a) Notwithstanding any law to the contrary, no later than
860 days following the effective date of this amendatory Act of
9the 95th General Assembly and until subsection (b) is
10implemented, any fixed route public transportation services
11provided by, or under grant or purchase of service contracts
12of, the Suburban Bus Board shall be provided without charge to
13all senior citizens of the Metropolitan Region aged 65 and
14older, under such conditions as shall be prescribed by the
15Suburban Bus Board.
16    (b) Notwithstanding any law to the contrary, no later than
17180 days following the effective date of this amendatory Act of
18the 96th General Assembly, any fixed route public
19transportation services provided by, or under grant or purchase
20of service contracts of, the Suburban Bus Board shall be
21provided without charge to senior citizens aged 65 and older
22who meet the income eligibility limitation set forth in
23subsection (a-5) of Section 4 of the Senior Citizens and
24Disabled Persons Property Tax Relief and Pharmaceutical

1Assistance Act, under such conditions as shall be prescribed by
2the Suburban Bus Board. The Department on Aging shall furnish
3all information reasonably necessary to determine eligibility,

6Section shall relieve the Suburban Bus Board from providing
7reduced fares as may be required by federal law.

11    (a) Notwithstanding any law to the contrary, no later than
1260 days following the effective date of this amendatory Act of
13the 95th General Assembly and until subsection (b) is
14implemented, any fixed route public transportation services
15provided by, or under grant or purchase of service contracts
16of, the Commuter Rail Board shall be provided without charge to
17all senior citizens of the Metropolitan Region aged 65 and
18older, under such conditions as shall be prescribed by the
19Commuter Rail Board.
20    (b) Notwithstanding any law to the contrary, no later than
21180 days following the effective date of this amendatory Act of
22the 96th General Assembly, any fixed route public
23transportation services provided by, or under grant or purchase
24of service contracts of, the Commuter Rail Board shall be
25provided without charge to senior citizens aged 65 and older

12    Section 99. Effective date. This Act takes effect upon
