Amends the Illinois Highway Code. Provides that upon completion of the relocated highway and its opening to
public travel, the county shall have full authority over the relocated highway and that portion of the original location not incorporated into the new location (rather than requiring that the original location be considered abandoned). Provides that for any portion of the original location not incorporated into the new location of the highway, the county board may transfer road jurisdiction to another highway authority or vacate, transfer, or sell the property interest.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Highway Code is amended by changing |
5 |
| Section 5-107 as follows:
|

| Sec. 5-107.
Relocations of county highways may be made |
8 |
| during the
improvement thereof according to plans approved by |
9 |
| the county board and the
Department. Upon completion of the |
10 |
| relocated highway and its opening to
public travel, the new |
11 |
| location shall become the location of the county
highway and |
12 |
| the county shall have full authority over the relocated highway |
13 |
| and that portion of the original location not incorporated into |
14 |
| the new location. For any portion of the original location not |
15 |
| incorporated into the new location, the county board, by the |
16 |
| process established by law, may transfer road jurisdiction to |
17 |
| another highway authority or vacate, transfer, or sell the |
18 |
| property interest. original location shall be considered |
19 |
| abandoned as a county
highway. |

| Pending the completion and opening of the relocation, the |
21 |
| county
board shall have full authority over the existing county |
22 |
| highway and shall
also have power to lay out the relocation, |
23 |
| acquire rights-of-way, by
condemnation or otherwise, and take |
