305 ILCS 5/5-27 new











     Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides for a minimum monthly personal needs allowance  for
institutionalized persons who are eligible for Medicaid.  Provides that the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act, so that the person's total monthly personal needs allowance from both State and federal sources equals $50. Effective immediately.

    AN ACT concerning public aid.

    Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

    Section 5. The Illinois Public Aid Code is amended  by 
5
adding Section 5-27 as follows:

    (305 ILCS 5/5-27 new)

    Sec. 5-27. Personal needs allowance. Subject to 
8
appropriation, for a person who is an inpatient in an 
9
institution or facility for which payments are made under this 
10
Article throughout a month and who is determined to be eligible 
11
for medical assistance under this Article, the State shall pay 
12
an amount in addition to the minimum monthly personal needs 
13
allowance authorized under Section 1902(q) of Title XIX of the 
14
Social Security Act (42 U.S.C. 1396a(q)), so that the person's 
15
total monthly personal needs allowance from both State and 
16
federal sources equals $50.

    Section 99. Effective date. This Act takes effect upon 
18
becoming law.
