AMENDMENT TO SENATE BILL 3388 




2    AMENDMENT NO. ______. Amend Senate Bill 3388, AS AMENDED, 
3with reference to page and line numbers of House Amendment No. 
41 as follows:
 
5on page 7, by replacing lines 6 through 8 with the following:
6    ""Sequester" means permanent storage of carbon dioxide by 
7injecting it into"; and


 
8on page 58, by replacing lines 25 and 26 with the following:
9"Any mediator retained to assist with mediating disputes 
10between the parties regarding the sourcing agreement shall be"; 
11and
 
12on page 59, line 1, by replacing "90" with "60"; and
 
13on page 93, by replacing lines 14 through 24 with the 
14following:

1        "In circumstances whereby a carbon dioxide pipeline 
2    creates a substantial danger to the environment or to the 
3    public health of persons or to the welfare of persons where 
4    such danger is to the livelihood of such persons, the 
5    State's Attorney or Attorney General, upon the request of 
6    the Commission or on his or her own motion, may institute a 
7    civil action for an immediate injunction to halt any 
8    discharge or other activity causing or contributing to the 
9    danger or to require such other action as may be necessary.  
10    The court may issue an ex parte order and shall schedule a 
11    hearing on the matter not later than 3 working days after 
12    the date of injunction.  The Commission"; and
 
13on page 105, line 12, after the period, by inserting "Costs for 
14which a person is liable under this subsection (d) are in 
15addition to any other fees, penalties, or other relief provided 
16under this Act or any other law.".
