1     AN ACT concerning aging.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Elder Abuse and Neglect Act is amended by
5 changing Section 3.5 as follows:
 
6     (320 ILCS 20/3.5)
7     Sec. 3.5. Other Responsibilities. The Department shall
8 also be responsible for the following activities, contingent
9 upon adequate funding:
10     (a) promotion of a wide range of endeavors for the purpose
11 of preventing elder abuse, neglect, financial exploitation,
12 and self-neglect in both domestic and institutional settings,
13 including, but not limited to, promotion of public and
14 professional education to increase awareness of elder abuse,
15 neglect, financial exploitation, and self-neglect, to increase
16 reports, and to improve response by various legal, financial,
17 social, and health systems;
18     (b) coordination of efforts with other agencies, councils,
19 and like entities, to include but not be limited to, the Office
20 of the Attorney General, the State Police, the Illinois Law
21 Enforcement Training Standards Board, the State Triad, the
22 Illinois Criminal Justice Information Authority, the
23 Departments of Public Health, Public Aid, and Human Services,

1 the Family Violence Coordinating Council, the Illinois
2 Violence Prevention Authority, and other entities which may
3 impact awareness of, and response to, elder abuse, neglect,
4 financial exploitation, and self-neglect;
5     (c) collection and analysis of data;
6     (d) monitoring of the performance of regional
7 administrative agencies and elder abuse provider agencies;
8     (e) promotion of prevention activities;
9     (f) establishing and coordinating an aggressive training
10 program on the unique nature of elder abuse cases with other
11 agencies, councils, and like entities, to include but not be
12 limited to the Office of the Attorney General, the State
13 Police, the Illinois Law Enforcement Training Standards Board,
14 the State Triad, the Illinois Criminal Justice Information
15 Authority, the State Departments of Public Health, Public Aid,
16 and Human Services, the Family Violence Coordinating Council,
17 the Illinois Violence Prevention Authority, and other entities
18 that may impact awareness of and response to elder abuse,
19 neglect, financial exploitation, and self-neglect;
20     (g) solicitation of financial institutions for the purpose
21 of making information available to the general public warning
22 of financial exploitation of the elderly and related financial
23 fraud or abuse, including such information and warnings
24 available through signage or other written materials provided
25 by the Department on the premises of such financial
26 institutions, provided that the manner of displaying or

1 distributing such information is subject to the sole discretion
2 of each financial institution; and
3     (g-1) developing by joint rulemaking with the Department of
4 Financial and Professional Regulation minimum training
5 standards which shall be used by financial institutions for
6 their current and new employees with direct customer contact;
7 the Department of Financial and Professional Regulation shall
8 retain sole visitation and enforcement authority under this
9 subsection (g-1); the Department of Financial and Professional
10 Regulation shall provide bi-annual reports to the Department
11 setting forth aggregate statistics on the training programs
12 required under this subsection (g-1); and
13     (h) coordinating efforts with utility and electric
14 companies to send notices in utility bills to explain to
15 persons 60 years of age or older their rights regarding
16 telemarketing and home repair fraud.

19     Section 99. Effective date. This Act takes effect upon
20 becoming law.
