1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing Home Care Act is amended by changing
5 Section 3-202 as follows:
 
6     (210 ILCS 45/3-202)  (from Ch. 111 1/2, par. 4153-202)
7     Sec. 3-202. The Department shall prescribe minimum
8 standards for facilities. These standards shall regulate:
9         (1) Location and construction of the facility,
10     including plumbing, heating, lighting, ventilation, and
11     other physical conditions which shall ensure the health,
12     safety, and comfort of residents and their protection from
13     fire hazard;
14         (2) Number and qualifications of all personnel,
15     including management and nursing personnel, having
16     responsibility for any part of the care given to residents;
17     specifically, the Department shall establish staffing
18     ratios ratios for facilities which shall specify the number
19     of staff hours per resident of care that are needed for
20     professional nursing care for various types of facilities
21     or areas within facilities;
22         (3) All sanitary conditions within the facility and its
23     surroundings, including water supply, sewage disposal,

1     food handling, and general hygiene, which shall ensure the
2     health and comfort of residents;
3         (4) Diet related to the needs of each resident based on
4     good nutritional practice and on recommendations which may
5     be made by the physicians attending the resident;
6         (5) Equipment essential to the health and welfare of
7     the residents;
8         (6) A program of habilitation and rehabilitation for
9     those residents who would benefit from such programs;
10         (7) A program for adequate maintenance of physical
11     plant and equipment;
12         (8) Adequate accommodations, staff and services for
13     the number and types of residents for whom the facility is
14     licensed to care, including standards for temperature and
15     relative humidity within comfort zones determined by the
16     Department based upon a combination of air temperature,
17     relative humidity and air movement. Such standards shall
18     also require facility plans that provide for health and
19     comfort of residents at medical risk as determined by the
20     attending physician whenever the temperature and relative
21     humidity are outside such comfort zones established by the
22     Department. The standards must include a requirement that
23     areas of a nursing home used by residents of the nursing
24     home be air conditioned and heated by means of operable
25     air-conditioning and heating equipment. The areas subject
26     to this air-conditioning and heating requirement include,

1     without limitation, bedrooms or common areas such as
2     sitting rooms, activity rooms, living rooms, community
3     rooms, and dining rooms. No later than July 1, 2008, the
4     Department shall submit a report to the General Assembly
5     concerning the impact of the changes made by this
6     amendatory Act of the 95th General Assembly;
7         (9) Development of evacuation and other appropriate
8     safety plans for use during weather, health, fire, physical
9     plant, environmental and national defense emergencies; and
10         (10) Maintenance of minimum financial or other
11     resources necessary to meet the standards established
12     under this Section, and to operate and conduct the facility
13     in accordance with this Act.
