SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-6-1.2 new

    Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may fix, charge, and collect fees not exceeding the reasonable cost of the service for all emergency services rendered by the municipality against persons, businesses, and other entities who are not residents of the municipality. Specifies that the fee shall be computed at a rate not to exceed $250 per hour per vehicle and not to exceed $70 per hour per firefighter responding to a call for emergency assistance. Provides that those amounts shall be adjusted annually to reflect changes in the Consumer Price Index during the previous 12-month period. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Municipal Code is amended by adding
5 Section 11-6-1.2 as follows:
 
6     (65 ILCS 5/11-6-1.2 new)
7     Sec. 11-6-1.2. Fee for emergency services.
8     (a) The corporate authorities of a municipality may fix,
9 charge, and collect fees not exceeding the reasonable cost of
10 the service for all emergency services rendered by the
11 municipality against persons, businesses, and other entities
12 who are not residents of the municipality.
13     (b) The fee may not be assessed against residents of the
14 municipality or persons who request fire protection coverage
15 for an unprotected area and pay to the municipality an amount
16 equal to the municipality's fire protection tax levied pursuant
17 to Section 11-7-1.
18     (c) The fee shall be computed at a rate not to exceed $250
19 per hour per vehicle and not to exceed $70 per hour per
20 firefighter responding to a call for emergency assistance.
21 Beginning January 1, 2011, those amounts shall be adjusted
22 annually to reflect changes in the consumer price index-u

1 be levied to reimburse the municipality for extraordinary
2 expenses of materials used in rendering such emergency
3 services. No fee shall be imposed for services for which the
4 total cost is less than $50.
5     (d) All revenue from the fees assessed pursuant to this
6 Section shall be deposited into the general fund of the
7 municipality.
8     (e) For the purpose of this Section, "consumer price
9 index-u" means the index published by the Bureau of Labor
10 Statistics of the United States Department of Labor that
11 measures the average change in prices of goods and services
12 purchased by all urban consumers, United States city average,
13 all items, 1982-84 = 100.
 
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
