AMENDMENT TO SENATE BILL 2184

2     AMENDMENT NO. ______. Amend Senate Bill 2184 as follows:
 
3 on page 2, immediately below line 10 by inserting:
4     ""Geological Survey" means the Illinois State Geological
5 Survey."; and
 
6 on page 2, line 17, immediately after "is", by inserting "equal
7 to or"; and
 
8 on page 2, line 18 by deleting "70 gallons per minute or"; and
 
9 on page 2, line 22, immediately after "is", by inserting "equal
10 to or"; and
 
11 on page 2, line 22 by deleting "70 gallons per minute or"; and
 
12 on page 3, immediately below line 25 by inserting the

2     ""Surface water" means a pond, lake, reservoir, stream,
3 creek, or river.
4     "Water authority" means a local governmental body
5 established by referendum under the Water Authorities Act (70
6 ILCS 3715/).
7     "Water survey" means the Illinois State Water Survey."; and
 
8 on page 6, lines 1 and 2, by replacing "which is capable of
9 producing more than 100,000 gallons on any day" with "which is
10 capable of producing more than 100,000 gallons on any day"; and
 
11 by replacing lines 17 through 25 on page 7 and lines 1 through
12 4 on page 8 with the following:
13     "Sec. 5.3. Water use reporting. Any person or land occupier
14 that is responsible for a point of withdrawal classified as a
15 high-capacity well, high-capacity intake, or public water
16 supply shall participate in the Illinois State Water Survey's
17 Illinois Water Inventory Program. However, high-capacity wells
18 used for agricultural irrigation and high-capacity intakes
19 used for agricultural irrigation are exempt from this Section
20 for the first 5 years after the effective date of this
21 amendatory Act of the 96th General Assembly. A person or land
22 occupier that is responsible for a point of withdrawal
23 classified as a high-capacity well or high-capacity intake used
24 for irrigation for agriculture shall determine water use

1 through estimation methods deemed acceptable by the Illinois
2 State Water Survey. A person or land occupier that is
3 responsible for a point of withdrawal that is classified as a
4 high-capacity well or a high-capacity intake used for
5 irrigation that lies within the boundaries of a water authority
6 or other local government entity that estimates irrigation
7 withdrawals through a method deemed acceptable by the Illinois
8 State Water Survey is exempt from participating as an
9 individual in the Illinois Water Inventory Program.".
