| AMENDMENT NO. ______. Amend Senate Bill 2009 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Public University Energy Conservation Act |
| 5 |
| is amended by changing Section 5-10 as follows:
|

| (110 ILCS 62/5-10)
|
| 7 |
| Sec. 5-10. Energy conservation measure. "Energy |
| 8 |
| conservation
measure" means any improvement, repair, |
| 9 |
| alteration, or betterment of any
building or facility, subject |
| 10 |
| to all applicable building codes, owned or operated by a public |
| 11 |
| university or any
equipment, fixture, or furnishing to be added |
| 12 |
| to or used in any
such building or facility
that is designed to |
| 13 |
| reduce
energy consumption or operating costs, and may include, |
| 14 |
| without limitation,
one or more of the following:
|
| 15 |
| (1) Insulation of the building structure or systems |
| 16 |
| within the building.
|

| (2) Storm windows or doors, caulking or |
| 2 |
| weatherstripping, multiglazed
windows or doors, heat |
| 3 |
| absorbing or heat reflective glazed and coated
window or |
| 4 |
| door systems, additional glazing, reductions in glass |
| 5 |
| area, or
other window and door system modifications that |
| 6 |
| reduce energy consumption.

| 7 |
| (3) Automated or computerized energy control systems.
|
| 8 |
| (4) Heating, ventilating, or air conditioning system |
| 9 |
| modifications or
replacements.
|
| 10 |
| (5) Replacement or modification of lighting fixtures |
| 11 |
| to increase the
energy efficiency of the lighting system |
| 12 |
| without increasing the overall
illumination of a facility, |
| 13 |
| unless an increase in illumination is necessary
to conform |
| 14 |
| to the applicable State or local building code for the |
| 15 |
| lighting
system after the proposed modifications are made.

| 16 |
| (6) Energy recovery systems.
|
| 17 |
| (7) Energy conservation measures that provide |
| 18 |
| long-term operating cost
reductions.
|
| 19 |
| Until January 1, 2015, "energy conservation measure" |
| 20 |
| includes a renewable energy center pilot project at Eastern |
| 21 |
| Illinois University, provided that the university obtains a |
| 22 |
| performance bond to guarantee the energy savings. |
