SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/13.7 new

    Amends the Environmental Protection Act. Provides that no health care institution, or any employee, staff person, contractor, or other person under the direction or supervision of a health care institution, may discharge, dispose of, flush, pour, or empty any unused medication into a public wastewater collection system or a septic system. Defines "health care institution" and "public wastewater collection system". Makes a violation a petty offense subject to a $500 fine.

1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Environmental Protection Act is amended by
5 adding Section 13.7 as follows:
 
6     (415 ILCS 5/13.7 new)
7     Sec. 13.7. Release of unused medication by health care
8 institution.
9     (a) In this Section:
10     "Health care institution" means any public or private
11 institution, facility, or agency licensed, certified, or
12 otherwise authorized by State law to administer health care in
13 the ordinary course of business, including hospitals, nursing
14 homes, residential health care facilities, home health care
15 agencies, hospice programs operating in this State,
16 institutions, facilities or agencies that provide services to
17 persons with mental health illnesses, or institutions,
18 facilities, or agencies that provide services for persons with
19 developmental disabilities.
20     "Public wastewater collection system" means any collection
21 system regulated by the Agency pursuant to this Act.
22     (b) No health care institution, or any employee, staff

4     (c) A violation of this Section is a petty offense subject
5 to a fine of $500.
