| AMENDMENT NO. ______. Amend Senate Bill 750, AS AMENDED, |

| with reference to page and line numbers of Senate Amendment No. |

| 4, by replacing everything from line 18 on page 2 to line 11 on |
5 |
| page 3 with the following:

| " (b-5) In fiscal year 2010, no appropriation made from |
7 |
| General funds to the State Board of Education, the Board of |
8 |
| Higher Education, the Community College Board, the Student |
9 |
| Assistance Commission, or any public university may be |
10 |
| decreased from its fiscal year 2009 general appropriation |
11 |
| level. An exception may be made only if a program's |
12 |
| appropriation is based on actual cost and that cost has been |
13 |
| determined by the Board or university to require a lesser |
14 |
| appropriation; however, the aggregate appropriation to those |
15 |
| Boards or universities for fiscal year 2010 shall not under any |
16 |
| circumstances represent a decrease from the fiscal year 2009 |
17 |
| aggregate general fund appropriation level for that Board or |
18 |
| university. |

| (b-10) Beginning in fiscal year 2011 and in each fiscal |
2 |
| year thereafter, in addition to the amounts required to be |
3 |
| transferred under subsection (b), an amount equal to the first |
4 |
| 40% of the amount of additional revenue generated through the |
5 |
| taxes imposed by this amendatory Act of the 96th General |
6 |
| Assembly in that fiscal year shall be transferred from the |
7 |
| General Revenue Fund to the Common School Fund. In addition, |
8 |
| beginning in fiscal year 2011 and in each fiscal year |
9 |
| thereafter, an amount equal to the next 10% of the amount of |
10 |
| additional revenue generated through those taxes shall be |
11 |
| transferred from the General Revenue Fund to the Higher |
12 |
| Education Fund. |

| (b-15) The Higher Education Fund is created as a special |
14 |
| fund in the State treasury. Moneys in this Fund may be used |
15 |
| only for purposes related to higher education. The Higher |
16 |
| Education Fund is not subject to administrative charges that |
17 |
| would in any way transfer any funds from the Higher Education |
18 |
| Fund into any other fund of the State. "; and |
19 |
| on page 3, line 16, by replacing "5,720, and 5.721" with |
20 |
| "5.720, 5.721, and 5.723"; and |
21 |
| on page 3, immediately below line 22, by inserting the |
22 |
| following: |

| "(30 ILCS 105/5.723 new)
