SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.148 new

    Amends the School Code. Requires the State Board of Education to adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2010 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2011. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Section
5 2-3.148 as follows:
 
6     (105 ILCS 5/2-3.148 new)
7     Sec. 2-3.148. Trans fats ban.
8     (a) For the purposes of this Section, "trans fat" means fat
9 that is considered trans fat by the U.S. Food and Drug
10 Administration. "Trans fat" does not include naturally
11 occurring trans fat. Food shall be deemed to contain trans fat
12 under this Section if the food is labeled as, lists as an
13 ingredient, or contains any kind of partially hydrogenated
14 vegetable oil, including without limitation vegetable
15 shortening or margarine. However, food shall not be deemed to
16 contain trans fat under this Section if the food contains less
17 than 0.5 grams of trans fat per serving.
18     (b) The State Board of Education shall adopt rules for the
19 elimination of vegetable oils containing trans fats in foods
20 served in public school cafeterias beginning on July 1, 2010
21 and for the elimination of all foods containing trans fats from
22 public schools beginning on July 1, 2011, which ban shall
23 include without limitation all foods sold as part of the school

1 breakfast and lunch programs under the School Breakfast and
2 Lunch Program Act, foods sold in vending machines on school
3 grounds, and competitive foods sold during school hours.
 
4     Section 99. Effective date. This Act takes effect upon
5 becoming law.
