Amends the Election Code. Prohibits the Governor from temporarily filling a vacancy in the office of U.S. Senator by appointment if the Governor has been arrested, charged, or indicted for a felony offense and the Governor has not been acquitted, the charge has not been dropped or dismissed, or, in the case of an arrest, there has been no charge or indictment within 30 days after the arrest. Provides that a vacancy filled by election under those circumstances is filled at the next consolidated or general election. Effective immediately.

| AN ACT concerning elections.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Election Code is amended by changing Section |
5 |
| 25-8 as follows:
|

| (10 ILCS 5/25-8) (from Ch. 46, par. 25-8)

| Sec. 25-8.
When a vacancy shall occur in the office of |
8 |
| United States
Senator from this state, the Governor shall make |
9 |
| temporary appointment to
fill such vacancy until the next |
10 |
| election of representatives in Congress ; except that the |
11 |
| Governor shall not make such a temporary appointment if the |
12 |
| Governor has been arrested, charged, or indicted for a felony |
13 |
| offense and the Governor has not been acquitted, the charge has |
14 |
| not been dropped or dismissed, or, in the case of an arrest, |
15 |
| there has been no charge or indictment within 30 days after the |
16 |
| arrest. The ,
at which time such vacancy shall be filled by |
17 |
| election at the next consolidated or general election. The , and |

| the senator so
elected pursuant to this Section shall take |

| office as soon thereafter as he shall receive his
certificate |
