Amends the Illinois Vehicle Code. Creates the offense of distracted driving. Provides that a person commits distracted driving when he or she operates a motor vehicle while doing anything that distracts the driver from driving in a lawful manner. Provides that a law enforcement officer may charge a person with distracted driving under this provision if the officer has stopped the person for any violation of a law or ordinance governing the movement of vehicles and if the officer determines that the driver was driving while distracted. Provides that any person who commits the offense of distracted driving is subject to an additional fine equivalent to the amount of the fine for the underlying offense that he or she committed.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
5 |
| Section 11-503.5 as follows: |

| (625 ILCS 5/11-503.5 new) |

| Sec. 11-503.5. Distracted driving. |
8 |
| (a) A person commits distracted driving when he or she |
9 |
| operates a motor vehicle while doing anything that distracts |
10 |
| the driver from driving in a lawful manner and the operation of |
11 |
| the motor vehicle is in violation of a law or ordinance |
12 |
| governing the movement of vehicles. |
13 |
| (b) A law enforcement officer may charge a person with |
14 |
| distracted driving under this Section if the officer has |
15 |
| stopped the person for any violation of a law or ordinance |
16 |
| governing the movement of vehicles and if the officer |
17 |
| determines that the driver was driving while distracted. |
18 |
| (c) Any person found in violation of subsection (a) of this |
19 |
| Section is subject to an additional fine equivalent to the |
20 |
| amount of the fine for the underlying offense that he or she |
21 |
| committed.
