Amends the Election Code. Eliminates the requirement that a unit of local government's clerk notify the Secretary of State at least 20 days before and within 30 days after a referendum on changing the unit's home rule status. Requires that, within 45 days after a referendum successfully changing a unit of local government's home rule status, the unit's clerk must notify the Secretary of State of the referendum results and the unit's status as a home rule unit or a non-home rule unit. Effective immediately.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Election Code is amended by changing Section |
5 |
| 28-8 as follows:
|

| Sec. 28-8. If a referendum to be held in accordance with |

| Section 28-7 of this
Act involved
involves the question of |

| whether a unit of local government shall
become a home rule |

| unit or shall cease to be a home rule unit and if that |
11 |
| referendum passed , then the clerk
of that unit of local |
12 |
| government shall, within 45
at least 20 days prior to the
|
13 |
| referendum, file with the Secretary of State a certified |
14 |
| statement
indicating when the referendum will be held. Within |
15 |
| 30 days after the
referendum ,
such clerk shall file with the |
16 |
| Secretary of State a certified
statement showing the results of |
17 |
| the referendum and the resulting status
of the unit of local |
18 |
| government as a home rule unit or a non-home rule
unit. The |
19 |
| Secretary of State shall maintain such certified statements in
|
20 |
| his office as a public record.
