Amends the Downstate Forest Preserve District Act. Provides that any district lands incorporated into a municipality organized after January 1, 2007 shall be deemed to be disconnected from the municipality unless the district gives express consent within 90 days after a court order declaring the municipality to be incorporated.

| AN ACT concerning forest preserve districts.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Downstate Forest Preserve District Act is |
| 5 |
| amended by changing Section 5.3 as follows:
|
| 6 |
| (70 ILCS 805/5.3) (from Ch. 96 1/2, par. 6308.3)

| Sec. 5.3. Property owned by a forest preserve district |
| 8 |
| shall not be
subject to annexation or incorporation without |
| 9 |
| express consent of the forest preserve
district. Any district |
| 10 |
| lands incorporated into a municipality organized after January |
| 11 |
| 1, 2007 shall be deemed to be disconnected from the |
| 12 |
| municipality unless the district gives express consent to |
| 13 |
| inclusion of those lands within 90 days after a court order |
| 14 |
| declaring the municipality to be incorporated.
