| HOUSE RESOLUTION
|

| WHEREAS, On April 1, 2005, Governor Rod Blagojevich filed |
3 |
| an emergency rule requiring pharmacies that sell |
4 |
| contraceptives to fill prescriptions for birth control without |
5 |
| delay; and
|
6 |
| WHEREAS, As part of that emergency rule, if the |
7 |
| contraceptive, or a suitable alternative, is not in stock, the |
8 |
| pharmacy must order or obtain the contraceptive or, if the |
9 |
| patient prefers, transfer the prescription to another local |
10 |
| pharmacy of the patient's choice or return it to the patient; |
11 |
| and |
12 |
| WHEREAS, The right of conscience is fundamental to the |
13 |
| right of freedom of religious expression; and |
14 |
| WHEREAS, The Health Care Right of Conscience Act protects |
15 |
| and respects a health care professional's right of conscience; |
16 |
| under this Act, a pharmacist may refuse to issue prescriptions |
17 |
| for abortifacients and contraceptives based upon his or her |
18 |
| beliefs; and |
19 |
| WHEREAS, There are pharmacists who practice in Illinois |
20 |
| only because the State has a Health Care Right of Conscience |
21 |
| Act; therefore, be it |
22 |
| RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE |
23 |
| NINETY-FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that |
24 |
| we urge the Governor to suspend the emergency rule filed April |
25 |
| 1, 2005 requiring pharmacies that sell contraceptive to fill |
26 |
| prescriptions for birth control without delay; and be it |
27 |
| further

| RESOLVED, That a suitable copy of this resolution be |
29 |
| presented to the Governor.
