Amends the Medical Practice Act of 1987. Provides that any person who fails any step of the
examination
for licensure as a medical doctor, doctor of osteopathy or osteopathic
medicine, or
doctor of chiropractic is entitled to take that step of the examination not more than 2 subsequent times (now, any person failing any examination for licensure a
total of 5 times shall thereafter be ineligible for further
examinations until that person submits to
the Department of Financial and Professional Regulation evidence of further formal professional study in an accredited institution). Provides that the licensing board may establish additional requirements for those applicants who, after having failed the same step of the examination 3 or more times, wish to take that step of the examination again.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Medical Practice Act of 1987 is amended by |
5 |
| changing Section 16 as follows:
|
6 |
| (225 ILCS 60/16) (from Ch. 111, par. 4400-16)
|

| (Section scheduled to be repealed on January 1, 2007)
|

| Sec. 16. Ineligibility for examination. Any person who |
9 |
| shall fail any
step of the examination
for licensure as a |
10 |
| medical doctor, doctor of osteopathy or osteopathic
medicine, |
11 |
| or
doctor of chiropractic in this or any other jurisdiction is |
12 |
| entitled to take that step of the examination not more than 2 |
13 |
| subsequent times at other examination periods within a time |
14 |
| period determined by the licensing board and upon payment of an |
15 |
| additional examination fee each time. The licensing board may |
16 |
| establish additional requirements for those applicants who, |
17 |
| after having failed the same step of the examination 3 or more |
18 |
| times, wish to take that step of the examination again
a
total |
19 |
| of 5 times shall thereafter be ineligible for further
|
20 |
| examinations until such time as such person shall submit to
the |
21 |
| Department evidence of further formal professional study, as |
22 |
| required by
rule of the Department,
in an accredited |
23 |
| institution .
