Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for any health care provider to request payment from an insured for services provided under the insured's health insurance plan, other than applicable copayments or deductibles. Provides that it is an unlawful practice for a health care provider to report to a credit agency an insured's failure to pay a bill for medical services when a health insurance plan has primary responsibility for payment.

| AN ACT concerning unfair business practices.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is amended by adding Section 2WW as follows: |
6 |
| (815 ILCS 505/2WW new)
|
7 |
| Sec. 2WW. Unfair health care provider billing practices. |
8 |
| (a) It is an unlawful practice for any health care provider |
9 |
| to do the following: |
10 |
| (1) request payment from an insured for medical |
11 |
| services covered under the insured's health insurance |
12 |
| plan, other than a copayment or deductible pursuant to the |
13 |
| terms of the health insurance plan; or |
14 |
| (2) report to a credit reporting agency the failure of |
15 |
| an insured to pay a bill for medical services when the |
16 |
| insured's health insurance plan has primary responsibility |
17 |
| for payment of the services. |
18 |
| (b) As used in this Section: |
19 |
| "Health care provider" means any physician, hospital |
20 |
| facility, or other person that is licensed or otherwise |
21 |
| authorized to deliver health care services. |
22 |
| "Insured" means an individual insured by a private or |
23 |
| public individual or group health insurance plan. |
24 |
| "Person" means a corporation, association, partnership, |
25 |
| limited liability company, sole proprietorship, or any other |
26 |
| legal entity.
