| AN ACT concerning liability.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Parental Responsibility Law is amended by |
5 |
| changing Section 2 as follows:
|

| (740 ILCS 115/2) (from Ch. 70, par. 52)

| Sec. 2. As used in this Act, unless the context otherwise |
8 |
| requires, the
terms specified have the meanings ascribed to |
9 |
| them:
|

| (1) "Legal guardian" means a person appointed guardian, or |
11 |
| given
custody, of a minor by a circuit court of the State, but |
12 |
| does not include a
person appointed guardian, or given custody, |
13 |
| of a minor under the Juvenile
Court Act or the Juvenile Court |
14 |
| Act of 1987.
|
15 |
| (2) "Minor" means a person who is above the age of 11 |
16 |
| years, but not yet
19 years of age.
|
17 |
| (3) "Acts which cause injury" means acts that directly or |
18 |
| proximately bring about or are the reason for the damage or |
19 |
| harm. |

| (4) "Wilful or malicious conduct" means conduct that has |
21 |
| the same mens rea as required for criminal conduct. "Wilful or |
22 |
| malicious conduct" does not include conduct where there was no |
23 |
| intent to cause damage or harm.
