Amends the School Construction Law. Provides that the State Board of Education shall rank school districts based on certain school construction priorities and notify each school district of its rank. Provides that the Commission on Government Forecasting and Accountability may take whatever actions are necessary to determine whether the State Board of Education is complying with this amendatory Act. Effective immediately.

| AN ACT concerning education.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|
4 |
| Section 5. The School Construction Law is amended by |
5 |
| changing Section 5-30 as follows:
|
6 |
| (105 ILCS 230/5-30)
|
7 |
| Sec. 5-30. Priority of school construction projects. The |
8 |
| State Board of
Education shall develop standards for the |
9 |
| determination of priority needs
concerning school construction |
10 |
| projects based upon approved district facilities
plans. Such |
11 |
| standards shall call for prioritization based on
the degree of |
12 |
| need and project type in the following order:
|
13 |
| (1) Replacement or reconstruction of school buildings |
14 |
| destroyed or damaged
by flood, tornado, fire, earthquake, |
15 |
| or other disasters, either man-made or
produced by nature;
|
16 |
| (2) Projects designed to alleviate a shortage of |
17 |
| classrooms due to
population growth or to replace aging |
18 |
| school buildings;
|
19 |
| (3) Projects resulting from interdistrict |
20 |
| reorganization
of school districts contingent on local |
21 |
| referenda;
|
22 |
| (4) Replacement or reconstruction of school
facilities |
23 |
| determined to be severe and continuing health or life |
24 |
| safety
hazards;
|
25 |
| (5) Alterations necessary to provide accessibility for |
26 |
| qualified individuals
with disabilities; and
|
27 |
| (6) Other unique solutions to facility needs.
|
28 |
| The State Board of Education may not make any material changes |
29 |
| to the standards in effect on May 18, 2004, unless the State |
30 |
| Board of Education is specifically authorized by law.

31 |
| The State Board of Education shall rank school districts |

| based on the priorities listed in this Section and notify each |
